STANDARD TERMS AND CONDITIONS<strong>Permit</strong> No. 13120Expiration Date: September 12, 2013Page 273 of291N.4 40 CFR 60.7(a)(3) 2112/99N.5 40 CFR 60.7(a)(4) 2/12199N.6 40 CFR 60.8 2112/99N.7 40 CFR 63.5(b)(4) 4/5/0240CFR63.743 (a)(l0) 3/2711998Boeing shall furnish written notification to the <strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong>,and EPA Region 10 for NSPS that have not been delegated to <strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong><strong>Air</strong> <strong>Agency</strong>, of the actual date of initial start-up of an affected NSPS facility asspecified in 40 CFR Part 60Boeing shall furnish written notification to the <strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong>,and EPA Region 10 for NSPS that have not been delegated to <strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong><strong>Air</strong> <strong>Agency</strong>, of any physical or operational change which may increase emissionrate of any air pollutant to which an NSPS standard applies unless change isexempted under 40 CFR 60.14(3)Provide notice to the <strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong>, and EPA Region 10 forNSPS that have not been delegated to Puge! <strong>Sound</strong> <strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong>, ofperformance test conducted to demonstrate compliance with standards in 40 CFRPart 60 (NSPS)For a new affected source or reconstructed affected source subject to a NESHAP,notifY the <strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong> of the intended construction orreconstruction. Submit in accordance with 63.9(b), Initial Notifications, andinclude information required for application for approval or construction orreconstruction as specified in 40 CFR 63.5(d). For major sources, application forapproval may be used to fulfill notification requirements.For construction or reconstruction of a spray booth or hangar subject to theaerospace NESHAP (40 CFR Part 63, Subpart GG) that does not have thepotential to emit 10 tons/year or more of an individual inorganic HAP or 25tons/year or more of all inorganic HAP combined, Boeing shall comply with 40CFR 63.5(b)(4) by notifYing the <strong>Puget</strong> <strong>Sound</strong> <strong>Clean</strong> <strong>Air</strong> <strong>Agency</strong> on an annualbasis on or before March I or each year.
