SUBPROGRAMME LEGAL SERVICES<br />

Overview<br />

The newly-established Division that emanated<br />

from the integration <strong>of</strong> existing legal structures<br />

in the DOD has successfully achieved strategic<br />

objectives through innovative thinking and selective<br />

management interventions concentrated on inservice<br />

training, as well as the effective utilisation<br />

<strong>of</strong> Reserves. The Division achieved most <strong>of</strong> its<br />

objectives and targets as planned, despite various<br />

challenges. The <strong>Defence</strong> Legal Services Division<br />

(DLSD) has made much progress and has invested<br />

considerable resources towards improving its<br />

internal capability and preparing for future needs by<br />

focusing on its human resources component.<br />

The <strong>Defence</strong> Legal Services Division participated in<br />

the execution <strong>of</strong> 20 exercises and provided optimal<br />

law support and legal advice to the planned 41<br />

operations, 12 ongoing operations and 16 shorter<br />

deployments, and the drafting <strong>of</strong> 17 bilateral and<br />

multilateral agreements.<br />

As part <strong>of</strong> the strategy <strong>of</strong> the Division, success was<br />

achieved in drafting three Bills that were approved by<br />

Cabinet for introduction in Parliament, namely the<br />

<strong>Defence</strong> Amendment Bill, the Castle Management<br />

Act Repeal Bill and the Prohibition <strong>of</strong> Mercenary<br />

Activities and Regulation <strong>of</strong> Certain Activities in a<br />

Country <strong>of</strong> Armed Conflict Act. Furthermore, the<br />

Division was instrumental in the drafting <strong>of</strong> the<br />

National Conventional Arms Control Amendment<br />

Bill. Also <strong>of</strong> note is the first South African<br />

Qualifications Authority-accredited Law <strong>of</strong> Armed<br />

Conflict Course that was presented to SANDF<br />

members by <strong>Defence</strong> Legal Services.<br />

The lack <strong>of</strong> specialists manifested itself through<br />

the non-availability <strong>of</strong> trained interpreters, the<br />

shortage <strong>of</strong> military law practitioners, an insufficient<br />

number <strong>of</strong> support personnel and the shortage <strong>of</strong><br />

representative Reserve Force support members.<br />

Management has made a concerted effort to recruit<br />

and staff experienced legal practitioners, skilled<br />

support personnel and representative Reserve<br />

Force members with the required legal experience.<br />

During this period, the Minister <strong>of</strong> <strong>Defence</strong><br />
