Resolution of the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong>, N.J.<strong>City</strong> Clerk File No.Agenda No.Approved:Res. 09-73010.Z.2SEP 0 9 2009TITLE:RESOLUTION AUTHORIZING AN AGREEMENT WITHSUNGARD PUBLIC SECTOR FOR THE SUPPORTOF PROPRIETARY COMPUTER HARDWARE AND SOFTWARECOUNCILoffered and moved adoption of the following resolution:WHEREAS, funds must be allocated for disaster recovery services related to the <strong>City</strong>'sproprietary hardware/software systems for personnel/payroll processing; andWHEREAS, SUNGARD PUBLIC SECTOR has agreed to provide the goods and servicesspecified as necessar by the Division ofInformation Technology; andWHEREAS, the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> has received a proposal from SUNGARD PUBLICSECTOR in the total amount for a one year period of $20.700.00 ; andWHEREAS, the <strong>City</strong> Purchasing Agent has certified that he Considers said proposal to be fairand reasonable; andWHEREAS, funds are available for thi contract in the following account:Administration!ivision of Information TechnologyAcct. No. 1-201-20-140-314 AMT. $20,700.00WHEREAS, SUNGARD PUBLIC SECTOR has completed and submitted a Business EntityDisclosure Certification which cerifies that SUNGARD PuBLIC SECTOR has not made anyrePortable contributions to the political or cadidate commttees lited Ù1 the BlIÙ1ess EntityDisclosúre Certification in the previouS bne year' (2005 contributiöii are exempt), and that theCÖntract will prohibit SUNGARD PUBLIC SECTOR from trg any reportable contributionsdurig the temi of the contract; andWHEREAS, SUNGARD PUBLIC SECTOR has submitted a Chapter 271 PoliticalContribution Disclosure Cerifcation at least 10 days prior to the award 0 f thi contract; andWHEREAS, the <strong>City</strong> is acquirg these serce directlyand openly as'a statutoriy perttedcontract pursuat to the proviions ofN.J.S.A. 19:44A-20.5 (Pay-to-Play Law); andWHEREAS, Robert Magro, the <strong>City</strong>'s IT Direcor, has detered and ceified Ù1 wrting thatthe value of the contract wil exceed $17,500; andWHEREAS, N.J.S.A. 40A: 11-5(1 )dd authories the <strong>City</strong> to award a contract without publicadverising if said contract is. for goods or serce to support or maitaÙ1 proprietar computerhardware and software aleady owned by the <strong>City</strong>.
