<strong>City</strong> Clerk File No. Res. 09-7351O.Z.7Agenda No.SEP 0 9 2009Approved:TITLE:, .RESOLUTION AUTHORIZING THE AWARD OF A CONTRACT TO PUBLICSERVICE ELECTRIC AND GAS COMPAN (PSE&G) FOR THE PURCHASE ANDINSTALLATION OF DECORATIVE STREET LIGHTS FOR THE CHRISTOPHERCOLUMBUS DRIVE ROADWAY IMPROVEMENTS PROJECT FROM CENTERSTREET TO MONMOUTH STREET PHASE I FOR THE DEPARTMENT OFADMINISTRATION, DIVISION OF ENGINEERING, TRAFFIC ANDTRANSPORTATIONCOUNCIL AS A WHOLEFOLLOWING RESOLUTION:OFFERED AND MOVED ADOPTION THEWHEREAS, the Muncipal Council of the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> on August 20, 2008 awarded acontract to Joseph M. Sanari, Inc., Hackensack, New <strong>Jersey</strong> for the Christopher ColumbusDrive Roadway Improvements Project Phase 1 Project No. 04-002 for the Deparment ofAdministration, Division of Engineering, Traffc and Transportation (Resolution No. 08-684); andWHEREAS, as par of the project, existing street lights wil be augmented with standard<strong>City</strong> of <strong>Jersey</strong> <strong>City</strong>IPSE&G (HACO) decorative street lights; andWHEREAS, PSE&G is the only entity who supplies power in the area; andWHEREAS, PSE&G is the only entity who can fush, intall and maintain the decorativestreet lights: andWHEREAS, the Local Public Contracts Law, N.J.S.A 40A:11-5(1) (£), authorizes the <strong>City</strong> tocontract without public bidding for the rendering of any servce by a public utliity companywhich is subject to the jursdiction of the Board of Public Utilities (BPU), in accordance withtarffs and schedules of charges made, charged or exacted, and filed with the BPU; andWHEREAS, PSE&G is a public utility company and has previously submitted a proposaldated November 20, 2008 in the amount of $21,548.49 to purchase and install the decorativestreet lights in accordance with taffs or schedules of charges filed with the BPU; andWHEREAS, the sum of $21,548.49 is available from Account No.04-215-55-842-991 topurchase and install the decorative street lights, and a 20% contingency which may be usedfor unforeseeable expenditures such as underground utility conflcts or possible additional<strong>Jersey</strong> <strong>City</strong> Police Traffc Director, for public safety, is also.available from Account No. 04-215-55-842-991; andNOW, THEREFORE, BE IT RESOLVED, by the Muncipal Council of<strong>City</strong> that:the <strong>City</strong> of <strong>Jersey</strong>1. A contract in the amount of $21,548.49 plus a 20% contingency to purchase andinstall the decorative street lights is awarded to PSE&G Company.2. The contract is awarded without public biddig pursuant to N.J.S.A. 40A: 11-5(1)(£);~3. The Purchasing Agent and Business Admstrator are authorized to take such otheraction as may be necessar to effectuate the pinose of the Resolution,j/tf/Pf
