EDELSTEIN, ESQ. OF SCHWARTZ, SIMON, EDELSTEIN, CELSKESSLERWHEREAS, the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> requires the services of Stephen J. Edelstein, Esq. ofSchwartz, Simon, Edelstein, Celso & Kessler to represent the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> in Laborand Employment matters and other legal matters; andWHEREAS, Stephen J. Edelstein, Esq. of Florham Park, New <strong>Jersey</strong> is an attorney-at-lawwith the State of New <strong>Jersey</strong> and qualified to perform these services and wil providethese services at the rate of $125 per hour, including expenses, not to exceed $250,000;andWHEREAS, NJ.s.A.19:44A-20.4 gt §g. (the Pay-to-Play Law) took effect on January 1,2006; andWHEREAS, in March 2009, the <strong>City</strong> publicly advertised a Request for Qualifcations(RFQ) using the "fair and open process" as described under the Pay-to-Play Law; andWHEREAS, Schwartz, Simon and Edelstein submitted a Qualifcation Statement inresponse to the <strong>City</strong>'s RFQ; andWHEREAS, this contract is made in accordance with the "fair and open process" of thePay-to-Play Law; andWHEREAS, Stephen Edelstein, Esq. has completed and submitted a Business EntityDisclosure Certification which certies ,that he has not made any reportablecontributions to the political or candidate committees listed in the Business EntityDisclosure Certication in the previous one year, and that the contractwil prohibit EricBernstein, Esq. of Bernstein & :Associates from makig any reportable contributionsduring the term of the contract; andWHEREAS, Stephen Edelstein, Esq. has subnlitted a Chapter 271 Political CòntributionDisclosure Certication at least 10 days prior to the award of th contract; andWHEREAS, Stephen Edelstein, Esq. has submitted its Certication of Compliance with the<strong>City</strong>'s Contractor Pay-to-Play Reform Ordinance 08-128 adopted on September 3,2008;andWHEREAS, fuds in the amount of $75,000 are available in the 2010 fical year temporarybudget in Account No.: 10-01-201-20-155-312.NOW, THEREFORE, BE IT RESOLVED by the Muncipal Counci of the <strong>City</strong> of <strong>Jersey</strong><strong>City</strong> that:1. An agreement is awarded to Stephen J. Edelstein, Esq. of Florham Park, New<strong>Jersey</strong> to provide these servces at the rate of $125 per hour, includig expenses, not toexceed $250,000.2. TIs contract shall be subject to the condition that the vendor providessatifactory evidence of compliance withlhe Mfiative Acton Amendments' to theLaw Against Discrimation, N.I.S.A. 10:5-31 gt~No200808a
