RIGHT TO ENTERThe right is reserved to the United States, its officers, agents, and employees toenter upon the Premises at any time and for any purpose necessary or convenient inconnection with government purposes; to make inspections, to make any other use ofthe site as may be necessary in connection with government purposes, and the Granteeshall have no claim for damages on account thereof against the United States or anyofficer, agent, or employee thereof except as otherwise provided by law.13. HOLD HARMLESS AND INDEMNITYa. The Grantee agrees to assume all risks of loss or damage to property andinjury or death to persons by reason of or attributable or incident to the condition orstate of repair of the Premises, except any conditions arising from latent defects, or toits possession and/or use of the Premises or the activities conducted under thisLicense. The Grantee expressly waives all claims against the United States of Americafor any such loss, damage, personal injury or death caused by or occurring as aconsequence of such condition, possession and/or use of the premises by the Grantee,other than conditions arising from any latent defect, or the conduct of activities or theperformance of responsibilities under this License by the Grantee. The Grantee furtheragrees to indemnify and hold harmless the United States of America, the Army, itsofficers, agents and employees, from and against all suits, claims, demands or actions,liabilities, judgments, costs and attorneys' fees arising out of, or in any mannerpredicated upon, personal injury, death or property damage resulting from, related to,caused by or arising out of the possession and/or use of the Premises by the Grantee.The Army will give the Grantee notice of any claim against it covered by this indemnityas soon after learning of such claim as practicable.b. The Grantee shall indemnify and hold harmless the United States of Americafrom any costs, expenses, liabilities, fines, or penalties resulting from discharges,emissions, spills, storagé, disposal, or any other action by the Grantee giving rise toUnited States of America liability, civil or criminal, or responsibility under Federal, stateor local environmental laws.c. Subcondition a.of this Condition and the obligations of the Grantee hereundershall survive the expiration or termination of the License. The Grantee's obligationhereunder shall apply whenever the United States incurs costs or liabilities for theGrantee's actions givipg rise to liability under this Condition.d. Any users, invitees, assignees, transferees, or successors shall be jointly andseverally responsible with the Grantee for those portions of the Premises under theircontrol.
