Resolution of the City of Jersey City, N.J.City Clerk File No.Agenda No.Approved:TITLE:Res. 09-7441O.Z.L6SEP 0 9 2009RESOLUTION AUTHORIZING THE AWARD OF CONTFAIRFIELD MAINTENANCE FOR GAS PUMP REPAIRSSTATE CONTRACT WITHOUT PUBLIC BIDDING FOR THE DOF AUTOMOTIVE SERVICES I DEPARTMENT OF PUBLIC WOCOUNCILADOPTION OF THE FOLLOWING RESOLUTION:OFFERED AND MOVEDWHEREAS, the Division of Automotive Services needs a contractor to provide gasPublic Works; andpump repair services for the gas pumps located at the Deparment ofWHEREAS, N.J.S.A. 40A:ll-12 of the Local Public Contracts Law authorizesmunicipalities to use a State contract without public bidding; andWHEREAS, Fairfield Maintenance, 4 Commerce Road, Fairfield, New Jersey being inpossession of State contract A 63628 submitted a proposal for gas pump repairs; andWHEREAS, Peter Folgado, Acting City Purchasing Director, has certified that heconsiders said quotation to be fair and reasonable; andWHEREAS, the term of the contractshall be for eleven (11) months effective as ofAugust 01, 2009 and the total cost of the contract shall not exceed $15,000.00; andWHEREAS, fuds in the amount of $3,000.00 are available in Account No. 10-01-201-26-315-310.NOW, THEREFORE, BE IT RESOLVED by the Municipal Council of the City ofJersey City that:1)2)A contract is awarded to Fairfeld Maintenance for gas pump repairs;The contract term is for eleven (11 ) months effective as of August 01,2009,and the maximum amount of the contrct shall not exceed $15,000.00;3) Ths contract is awarded without public bidding puruant to N.J.S.A. 40A:ll-12;4) Pursuant to N.J.A.C. 5:30-5.5(a), the continuation of the contract afer theexpenditue of fuds encumbered in the 2010 fiscal year temporar budgetshall be subject to the availabilty and appropnation of suffcient fuds in the2010 fiscal year permanent budget;5) Upon certification by an offcial or employee of the City authonzed to receive. the matenal pursuànt to the contract, that the same has been received and thatthe requirements of the contract met, then; payment to the contrctor shall bemade in accordace with the provisions of the Local Affairs Law, N.J.S.A.40A:5-1l!~; anda. \1 ~I I to the Law Agait Discnmination, N.J.S.A 1 0:5-31l!~.~\i"'~~7 .(Contiued on page 2)6) Ths contract award shall be subject to. the condition that the vendor provides~ .
