ARTICLE XIIIIndemnityThe CONSULTANT shall be liable to and hereby agrees toindemnify and hold harmless the CITY and employees of the CITY fromany damages and from costs and expenses to which the CITY and itsrespective employees may be subj ected, or which they may suffer orincur by, reason of any los s , property damage, bodi 1 y inj ury , ordeath, resulting solely from an error, omission, or negligent actof the CONSULTANT or anyone employed by the CONSULTANT in theperformance of this Contract. Said agreement shall indemnify anddefend the CITY, and their respective employees and shall continuein full force for ten (10) years, which is the applicable statuteof limitations.ARTICLE XIVENTIRE AGREEMENT1. This Agreement constitutes the entire agreement betweenCITY and CONSULTANT. It supersedes all prior or contemporaneouscommunications, representations ofagreement whether oral orwritten with respect to .the subjectmatter thereof and has beeninduced by no representations, statement or agreements other thanthose herein expressed.
