<strong>City</strong> Clerk File No.Agenda No.Approved: SEP 0 9 2009TITLE:RESOLUTION AUTHORIZING A COOPERATION AGREEMENT WITH THE JERSEY CITYPLANNING BOARD, ZONING BOARD OF ADJUSTMENT, MUNICIPAL UTILITIESAUTHORITY, ECONOMIC DEVELOPMENT CORPORATION, AND DEVELOPMENTCORPORATION, TO PARTICIPATE IN THE REVIEW AND IMPROVEMENT OF THEDEVELOPMENT PROCESSCOUNCILoffered and moved adoption of the following Resolution:WHEREAS, it is clear that the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> must improve its development process to ensurethat it is unform and fairly admistered, in order to restore the public trst; andWHEREAS, in order to achieve these goals, itan unbiased, independent legal audit andwas deemed appropriate and necessary to undertakeWHEREAS, the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> has engaged the services of former Dean of Seton Hall LawRonald J. Riccio,former Assistat US Attorney Walter Timpone, and Thomas Scrivo, who wrotean expert treatise on New <strong>Jersey</strong> Local Governent, from the Law Firm of McElroy, Deutsch,Mulvaney & Carenter, LLP, (Firm) who are fully and emiently qualiied to perform theseservices; andWHEREAS, the Firm wil review docuents and relevant locallegislation as well as to intervew<strong>City</strong> officials in an attorney-client privileged settg and provide the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> with awritten report docuentig its fidigs and providig recommendations to improve thedevelopment process; andWHEREAS, ths review wi requie the parcipation and cooperation of the various muncipalboards and agencies, in addition to the <strong>Jersey</strong> <strong>City</strong> Redevelopment Agency that has already agreedto cooperate by separate agreement, in order to pursue the common goal of restoring the publictrt in the development process; andWHEREAS, although the <strong>City</strong> has engaged the Fir and wi pay for the cost of performg theseservces, it is essential that there be unettered communcation the full exchange of inormationand docuents betwee the varous boards and agencies and the Fir, including the CoordinatigGroup of the <strong>City</strong>, and that the communcations are protected pursuant to the attorney clientpriviege and work product doctre as recogned by the State of New J~rsey; andWHEREAS, in order to provide these servces and preserve the attorney client priviege, it isnecessar for the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> and the <strong>Jersey</strong> <strong>City</strong> Plang Board, Zonig Board ofAdjustment, Muncipal Utities Authority, Economic Development Corporation, AndDevelopment Corporation, to enter into a cooperation agreement; andNOW, THEREFORE, BE IT RESOLVED by the Muncipal Counci of the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> thtthe Mayor or Business Admtrator and Co:roration Counel, are authoried to execute:
