AN ENDING 6:00 P.M., SATURAY,SEPTEMBER 12, 2009 AT THE REQUEST OF THE HEAVENLY TEMPLECOGIC FOR THE PUROSE OF A YOUTH RALYWHEREAS, the Division of Engineering, Traffc and Transportation has received an application fromthe Heavenly Temple COGlC to close Martin Luther King Drive from McAdoo Avenue to Warer Avenuebeginning i 0:00 a.m. and ending 6:00 p.m. Saturday, September 12, 2009 for the purpose of a youth rally; andWHEREAS, in accordance with the provisions of Section 296-71 and 296-72, a street may betemporarily closed for a block part or any recreational event to be conducted within an area not exceeding onecity block under certin conditions;WHEREAS, when one or more of the required conditions for a street closing are not met, in accordancewith Sections 296-74 (B) the Traffic Engineer may recommend to the City Council that Ol1e or more of therequirements of Sections 296-71, 296-72 and 296-73 be waived; andWHEREAS, the request to close Martin Luther King Drive, does not meet one or. more of thereqllirements set fort in Section 296-72(B)(2)(8) and Section 296.73 (D) because Marin LutherKing Drive isa cOmIercial street and the sta and end time are outside thetimes that are permitted; andWHEREAS, the closing of Marin Luther King Drive will not affect public safety or convenience, andin accordance with the provision of Section 296-74 (B) and th,e applicant has made a request to the City Councilthat one or more of the requirements set forth in Section 296-72 and 296.73 be waived.NOW THEREFORE BE IT RESOLVED, that the Municipal Council via adoption Of this resolutionauthorizes the closing of Marin Luther King Drive from McAdoo Avenue to.
