<strong>City</strong> Clerk File No.Agenda No.Approved:TITLE:°0.;~POR.ATP ",~RESOLUTION AUTHORIZING APROFESSIONALSERVICE CONTRACT AS ANEXTRAORDINARYUNSPECIFIABLE SERVICE WITHOUT SOLICITATION OFCOMPETITIV PROPOSALS TO HUERRESEARCH, INC., IN CONNECTIONWITH THE VAN WAGENEN - APPLE TREE HOUS:E RESTORATION (pHASE 11-INTERIOR RESTORATION), PROJECT NO. 2007-027 FOR THE DEPARTMENTOF ADMINISTRATION, DIVISION OF ARCHITECTURECOUNCILRESOLUTION:OFFERED AND MOVED ADOPTION OF THE FOLLOWINGWHEREAS, Phase II - Interior Restoration of the Van Wagenen Apple Tree House Restorationproject was awarded to Schtiller & Plevy, Inc., General Contractor on July 15,2009, Resolution No. 09-585;andWHEREAS, the New <strong>Jersey</strong> Historic Trust (NJHT)a grant in the amount of$575,000.00 for the interior restoration (Phase 2) ofthe owner provide an archaeologic documentation of artifacts found in and around the project, who is providing the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> withthe building has mandated thatsite; andWHEREAS, the Chief Architect of the <strong>City</strong> of Jèrsey <strong>City</strong> in the attached Certification datedAugust 3,2009 has determined that these services qualifY as Extraordinary & Unspecifiable Services (EUS)undèr the Local Public Contracts Law, N.J.S.A. 40A: i I-I et seq.; andWHEREAS, the Chief Architect of the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> has determined and certified in writingthat the value of the contract wil exceed $ i 7,500.00; andWHEREAS, the <strong>City</strong> is acquiring these services directly and openly as a statutorily permittedcontract pursuant to the provisions ofN.J.S.A. I 9:44A - 20.5 (New <strong>Jersey</strong> Local Unit Pay to Play Law), andHunter Research, Inc. has submitted its Certification of Compliance with the <strong>City</strong>'s Contractor Pay-to-Playreform Ordinance 08-128, adopted September 3,2008; andWHEREAS, Hunter Research, 'Inc., Historical Research Consultants, 120 West State Street,Trenton, New <strong>Jersey</strong> 08608 has submitted a proposal for their services in response to thethe sum of<strong>City</strong>'s request forTHIRTY mOUSANDFOUR HURED FORTY-NINE DOLLARS ($30,449.00); andWHEREAS, the funds are available for this expenditure fromAccount04-215-55-210-990P. O. No.9!1(,~SAmount$30,449.00WHEREAS, Ian Burrow, Ph.D., RPA, Vice Presidènt, has completed and submitted a BusinessEntity Disclosure Certification which certifies that Hunter Research, Inc. has not made any reportblecontributions to the political or candidate committees listed in the Business Entity Disclosure Certificationin the previous one year (2005 contributions are exempt), and that the contract wil prohibit Hunter Research,Inc. from making any reportble contributions during the term of the contract; and'WHREAS, Ian .Burrow, has submitted a Chapter 271 Political Contribution DisclosureCertification on behalf of Hunter Research, Inc.; and. .NOW, THEREFORE, BE IT RESOLVED by the Municipal Council of the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong>that:1. The Mayor or Business Administrator is authorized to . execute a professional servicesagreement with the fir of Mast Constrction Services, Inc. for a lump sum fee not toexceed THITY THOUSAN FOUR HlRED FORTY-NIN DOLLAS($30,449.00).
