OF NEE, BEACHAM & GANTNER TOREPRESENT THE CITY OF JERSEY CITY, THE JERSEY CITY POLICEDEPARTMENT AND MAYOR JERRAMIAH HEALY IN THE MA TIER OFASTRIAB V. THE CITY OF JERSEY CITY, ET AL.Q~WHEREAS, JOM Astriab and several other police officers have fied a complaint inFederal District Court against the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong>, the <strong>Jersey</strong> <strong>City</strong> PoliceDepartment, Chief Robert Troy, Mayor Jerramiah Healy and city officialsalleging they were denied promotion to the rank of police lieutenant fordiscriminatory and retaliatory reasons; andWHEREAS, the Corporation Counsel has recommended the appointment ofoutside counsel to represent the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong>, the <strong>Jersey</strong> <strong>City</strong> PoliceDepartment and Mayor Jerramiah Healy in this matter; andWHEREAS, special counsel agrees to provide these services at an hourly rate of $125.00per hour, including expenses, for a total amount not to exceed $30;000; andWHEREAS, N.I.S.A 19:44A-20.4 et seq. (the "Pay-to-Play Law") took effect on January1,2006; andWHEREAS, in March 2009, the <strong>City</strong> publicly advertised a Request for Qualfication(RFQ) using the "fair and open process" as described under the Pay-to-Play Law; andWHEREAS, Nee, Beacham & Gantner submitted a Qualification Statement in responseto the <strong>City</strong>'s RFQ andWHEREAS, this contract award is made in accordance with the "fair and open process"of the Pay-to-Play Law; andWHEREAS, the law firm of Nee, Beacham & Gantner has completed and submitted aBusiness Entity Disclosure Certiication which certies that he has not made anyreportable contributions to the political or candidate commttees listed in the BusinessEntity Disclosure Certiication in the previous one year, and that the contract wilprohibit Nee, Beacham & Gantner from making any reportable contrbutions durg theterm of the contract; andWHEREAS, Nee, Beacham & Gantner has submitted a Chapter 271 Political ContrbutionDisclosure Certification at least 10 days prior to the award of th contract; andWHEREAS, Nee, Beacham & Gantner has submitted its Certcation of Compliance withthe <strong>City</strong>'s Contractor Pay-to-Play Reform Ordinance 08-128 adopted on September 3,2008; andWHEREAS, funds are available for the cost of these servces in Account No.10-14-298-56-000-856.NOW, THEREFORE, BE IT RESOLVED by the Muncipal Counci of the <strong>City</strong> of <strong>Jersey</strong><strong>City</strong> that:1.
