TO PROVIDE LEGAL SERVICES TO THE CIOF JERSEY CITY IN CONNECTION WITH LITIGATION, LABOR ANDEMPLOYMENT MA TIERSa~'A "£-HÙWHEREAS, the City of Jersey City requires the services of Eric Bernstein, Esq. of Bernstein& Associates to represent the City of Jersey City in Litigation, Labor and Employmentmatters; andWHEREAS, Eric Bernstein, Esq. 2 North Road, Warren, New Jersey is an attorney-at-lawwith the State of New Jersey and qualified to perform these services and wil providethese services at the rate of $125 per hour, including expenses, not to exceed $100,000;andWHEREAS, N.r.S.A.19:44A-20.4 ~ ~. (the Pay-to-Play Law) took effect on January 1,2006; andWHEREAS, in March 2009, the Citypublicly advertised a Request for Qualifications(RFQ) using the "fair and open process" as described under the Pay-to-Play Law; andWHEREAS, Bernstein & Associates submitted a Qualification Statement in response to theCity's RFQ; andWHEREAS, this contract is made in accordance with the "fair and open process" of thePay-to-Play Law; andWHEREAS, Bernstein & Associates has completed and submitted a Business EntityDisclosure Certification which certifies that he has not made any reportablecontributions to the political or candidate committees listed in the Business EntityDisclosure Certification in the previous one year, and that the contract wil prohibit EricBernstein, Esq. of Bernstein & Associates from makg any reportable contrbutionsduring the term of the contract; andWHEREAS, Berntein & Associates has submitted a Chapter 271 Political ContributionDisclosure Certiication at least 10 days prior to the award of th contract; andWHEREAS, Bernstein & Associates has submitted its Certication of Compliancewith theCitys Contractor Pay-to-Play Reform Ordinance 08-128 adopted on September 3, 2008; ,and~~WHEREAS, fuds in the amount of.$20,000 are avaiable in the 2010 fical year temporarybudget in Account No.: 10-01-201-20-155-312.NOW, THEREFORE, BE IT RESOLVED by the Muncipal Counci of the City of Jersey1. An agreement is awarded to Eric Berntein, Esq. of BernteiI & Associates, 2North Road, Warren, New Jersey to provide legal servces to the City of Jersey City inconnection with'litigation, labor and employment matters.2. A copy of ths resolution wi be published in a newspaper of general cicuation. in the City of Jersey City as required by law with (10) days of the adoption of theresolution.
