Resolution of the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong>, N.J.<strong>City</strong> Clerk File No. Res. 09-756Agenda No. 1O.Z.28Approved:SEP 0 9 2009TITLE:RESOLUTION AUTHORIZING AN AGREEMENTWITH H&L SYSTEMS FOR THE SUPPORT OFPROPRIETARY COMPUTER SOFTWARECOUNCILoffered and moved adoption of the following resolution:WHEREAS, funds must be allocated for the continued support ofcollection/financial computer software systems; andthe <strong>City</strong>'s proprietary taxWHEREAS, H&L SYSTEMS has agreed to provide these services in the maner specified bythe Division of Information Technology; andWHEREAS, the <strong>City</strong>.of <strong>Jersey</strong> <strong>City</strong> has received a proposal from H&L SYSTEMS in the totalamount for it One year period of$lSO,OOO.OO ofwhich $2,000.00 will be available in thetemporary budget for this expenditure in accordance with Local Budget Law, N.J.S.A. 40A:4-let. seq.WHEREAS, the <strong>City</strong> Purchasing Agent has certified that he considers said proposal to be fairand reasonable; andAdministration!Division of Information TechnologyAcct. No. 01-201-20-140-314 AMT. $2,000.00WHEREAS, the remaining contract funds will be made available in the 2010 temporary andpermanent budgets; andWHEREAS, the award of the contract shall be subject to the availability and appropriation ofsuffcient funds in the 20 i 0 temporary and permanent budgets; andWHEREAS, the <strong>City</strong> is acquiring these services directly and openly as a statutorily permittedcontract pursuant to the provisions ofN.J.S,A. i 9:44A-20.S (Pay-to-Play Law); andWHEREAS, H&LSYSTEMS has completed and submitted a Business Entity DisclosureCertification which certifies that H&L SYSTEMS has not made any reportble contributions tothe political or candidate committees listed in the Business Entity Disclosure Certification in theprevious one year(200S contributions are exempt), and that the contract wil prohibit H&LSYSTEMS from making any reportble contributions during the term of the contract; andWHEREAS, H&L SYSTEMS has submitted a Chapter 271 Political Contribution DisclosureCertification at least i 0 days prior to the award of this contract.WHEREAS, N.J.S.A. 40A:II-S(I) (dd) authorizes the <strong>City</strong> to award a contract without publicadvertising if said contract is for goods or services to support or maintain proprietar computerhardware and softare alreadyowned by the <strong>City</strong>; andWHEREAS, the <strong>City</strong> is acquiring these serVices directly and openly as a statutorily permittedcontraetpursuat to the provisions ofN.J.S.A. 19:44Ao20.S (pay-to-Play Law).
