A. 40A: 12-13 (a)WHEREAS, the <strong>City</strong> of <strong>Jersey</strong> <strong>City</strong> (<strong>City</strong>) is the owner ofreal property not neededfor a public use identified on the map as Block 1819, Lot 2.A a/k/a 146 Belmont Avenue(Property);andWHEREAS, the <strong>City</strong> leases the Property to Metro Spec Corp. for use as a parking lot fora daycare center operated by Metro Spec; andWHEREAS, the <strong>City</strong>'s lease with Metro Spec is for fifty (50) years commencing onSeptember 1,2004 and ending on August 31, 2054;andWHEREAS, the <strong>City</strong> desires to sell an easement to crossover the Propert so that abuilding under construction at 148 Belmont A venue wil have a means of emergencyegress; andWHEREAS, the easement area is approximately 3 feet wide by 142 feet long; andWHEREAS, the sale of an easement will not affect Metro spec's use of the Propertyas a parking lot; andWHEREAS, N.J.S.A. 40A: 12-13 (a), authonzes the salt( ofan easement to any privateperson by public bidding to the highest bidder after advertisement thereof in a newspaperof general circulation in the municipality.NOW, THEREFORE'BE IT RESOLVED, by the Municipal Council ofthe <strong>City</strong> of<strong>Jersey</strong> <strong>City</strong> that: '1. The <strong>City</strong> shall sell an easement pursuant to N.J.S.A. 40A: 12-13 (a) to the lughestbidder, and upon the terms, conditions, restnctions and limitations listed below:(a) The minimum bid for the easement shall be $15,000.00(b) Bids shall be in increments of$l,OOO.OO.(c) The easement shall commence upon the execution date of the EasementAgreement by the appropnate <strong>City</strong> offcials and shall continue in effectin perpetuity.(d) No structure shall be erected upon the easement area and the eaementarea shall be used solely as an emergency egress from the building at148 Belmont Avenue.2. Bids shall be received on a regular business day at a time and a date to be 'determined by the Real Estate Manager, said date must be within fort-five (45)days of the passage of this resolution. Ifbids are not received witlun fort-five(45) days, this resolution shall be deemed null and void.3. When the Real Estate Maner determines a date for receiving bids, notice ofthedate shall be advertised in a newspaper circulating in the municipality by two(2) inrtions at least once a week dunng two (2) consecutive weeks; the lastpublication not to be earlier than seven (7) days pnor to the date for acceptingbids.1l20.o9095
