Gentlemen:
Pending the adoption of the annual budget. I hereby request that
an appropriation of $2,000.00 be made to cover the expenses of the "Military
Aid" account.
This order is an emergency necessity as the quota allowed for January;,
February and March will be exceeded.

Your letter of January 31, last addressed to Mr. Kaan, relative
to the gasoline storage license granted by the Board of Aldermen in the
name of Francis X. McCarthy at location #577-579 Summer streetf was referred
to me by Mr. Kaan.
I am of the opinion that the Board of Aldermen has no right to
revoke such a license. The Board of Aldermen in acting upon such petitions are
functioning, not as a Charter Body, namely the Board of Aldermen, but as the
duly appointed agent of the State Fire Marshal under a delegation of power
given by the State Fire Marshal to the Board of Aldermen under date -of June
15, 1923 and the powers of the agent are limited to the issuance of licenses.
By the terms of General Laws, Chapter 148,'Section 2, and
amendments thereto, the Provisions of Section 14, said Chapter, which deal
with a revocation for cause after notice and a 'hearing by the Board of Aldermen
does not apply to the Metropolitan District of which Somerville is a
part. Under Section 30 of said Chapter the State Fire Marshal is given, with-
