Gentlemen:<br />

Pending the adoption <strong>of</strong> the annual budget. I hereby request that<br />

an appropriation <strong>of</strong> $2,000.00 be made to cover the expenses <strong>of</strong> the "Military<br />

Aid" account.<br />

This order is an emergency necessity as the quota allowed for January;,<br />

February and March will be exceeded.<br />

Your letter <strong>of</strong> January 31, last addressed to Mr. Kaan, relative<br />

to the gasoline storage license granted by the Board <strong>of</strong> Aldermen in the<br />

name <strong>of</strong> Francis X. McCarthy at location #577-579 Summer streetf was referred<br />

to me by Mr. Kaan.<br />

I am <strong>of</strong> the opinion that the Board <strong>of</strong> Aldermen has no right to<br />

revoke such a license. The Board <strong>of</strong> Aldermen in acting upon such petitions are<br />

functioning, not as a Charter Body, namely the Board <strong>of</strong> Aldermen, but as the<br />

duly appointed agent <strong>of</strong> the State Fire Marshal under a delegation <strong>of</strong> power<br />

given by the State Fire Marshal to the Board <strong>of</strong> Aldermen under date -<strong>of</strong> June<br />

15, 1923 and the powers <strong>of</strong> the agent are limited to the issuance <strong>of</strong> licenses.<br />

By the terms <strong>of</strong> General Laws, Chapter 148,'Section 2, and<br />

amendments thereto, the Provisions <strong>of</strong> Section 14, said Chapter, which deal<br />

with a revocation for cause after notice and a 'hearing by the Board <strong>of</strong> Aldermen<br />

does not apply to the Metropolitan District <strong>of</strong> which <strong>Somerville</strong> is a<br />

part. Under Section 30 <strong>of</strong> said Chapter the State Fire Marshal is given, with-<br />
