In response to your letter <strong>of</strong> February 18, last, requesting<br />

an opinion with reference to the order presented by Alderman James F. Stynes<br />

and approved February 18, last "as to the "legal rights <strong>of</strong> this Board in revoking<br />

an? permit or license granted to the Boston Elevated Railway Company •<br />

for the operation <strong>of</strong> Bus Routes, the operation <strong>of</strong> buses, and the maintaining<br />

<strong>of</strong> cross overs".- . .<br />

I am <strong>of</strong> the opinion that the Board <strong>of</strong> Aldermen has power to<br />

revoke, under the provisions <strong>of</strong> General Laws, Chapter 161, Section 77 and under<br />

the provisions <strong>of</strong> our revised ordinances,. Chapter 28, Section 32. Under,<br />

the language <strong>of</strong> said Chapter 161, Section 77, the Board, "if public necessity<br />

require, may for good and sufficient reasons, to be stated in the order there<br />

for, revoke the location <strong>of</strong> a street railway in any public way therein". If<br />

the Company does not within thirty days after the adoption <strong>of</strong> the order <strong>of</strong><br />

revocation consent to the revocation In writing the order for revocation is<br />

not valid until approved by the.Department <strong>of</strong> Public Utilities on petition by<br />

the Board <strong>of</strong> Aldermen.<br />
