In response to your letter of February 18, last, requesting
an opinion with reference to the order presented by Alderman James F. Stynes
and approved February 18, last "as to the "legal rights of this Board in revoking
an? permit or license granted to the Boston Elevated Railway Company •
for the operation of Bus Routes, the operation of buses, and the maintaining
of cross overs".- . .
I am of the opinion that the Board of Aldermen has power to
revoke, under the provisions of General Laws, Chapter 161, Section 77 and under
the provisions of our revised ordinances,. Chapter 28, Section 32. Under,
the language of said Chapter 161, Section 77, the Board, "if public necessity
require, may for good and sufficient reasons, to be stated in the order there
for, revoke the location of a street railway in any public way therein". If
the Company does not within thirty days after the adoption of the order of
revocation consent to the revocation In writing the order for revocation is
not valid until approved by the.Department of Public Utilities on petition by
the Board of Aldermen.
