RESOLUTION A MARCH 27, <strong>2001</strong><br />

At a regular meeting of the Board of Commissioners of the<br />

<strong>County</strong> of <strong>Saginaw</strong> held in the City of <strong>Saginaw</strong>, Michigan, on the<br />

27th day of March, <strong>2001</strong>, at 5:00 o'clock, p.M., Michigan time.<br />

Jeanine A. Collison, Robert L. Fish, Eddie F. Foxx, James M.<br />

Graham, Todd M. Hare, Kenneth B. Horn, Richard F. Mallette,<br />

Michael P. O'Hare, Carl E. Ruth, Connie D. Smith, Robert M. Woods<br />

Jr., Patrick A. Wurtzel<br />

ABSENT --- none<br />

The following resolution was offered by Commissioner Hare and<br />

seconded by Commissioner Graham:<br />

WHEREAS, the <strong>County</strong> of <strong>Saginaw</strong> (the "<strong>County</strong>"), by resolution<br />

of its Board of Commissioners, has established a Department of<br />

Public Works for the administration of the powers conferred upon<br />

the <strong>County</strong> by Act 185 of the Michigan Public Acts of 1957, as<br />

amended ("Act 185"), which Department is administered by the<br />

<strong>Saginaw</strong> <strong>County</strong> Public Works Commissioner, acting as the Board of<br />

Public Works, under the general control of the Board of<br />

Commissioners; and<br />

WHEREAS, the Township Board of the Township of Taymouth (the<br />

“Township”), by resolution adopted on March 8, <strong>2001</strong>, has requested<br />

the <strong>County</strong>, acting through its Department of Public Works under<br />

Act 185, to assist the Township in financing the acquisition and<br />

construction of water supply system improvements in the Township<br />

consisting of a water transmission line and related appurtenances<br />

running from the intersection of Nichols Road and Verne Road along<br />

Verne Road to Dorwood Road, then along Dorwood Road to E. Birch<br />

Run Road, then along E. Birch Run Road to Nichols Road (the<br />

“Project”); and<br />

WHEREAS, the establishment of a <strong>County</strong> project as requested<br />

in the foregoing resolution will protect the public health and<br />

welfare of the citizens of the Township to be served by the<br />

Project.<br />

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS<br />

OF THE COUNTY OF SAGINAW, as follows:<br />

1. The Board of Commissioners of the <strong>County</strong> of <strong>Saginaw</strong><br />

hereby authorizes and directs the Public Works Commissioner,<br />

acting as the Board of Public Works, to undertake the Project<br />

under Act 185 as requested by the Township.<br />

2. Said <strong>County</strong> project shall be known as the "Taymouth<br />

Township <strong>2001</strong> Water Supply System Improvements."<br />

3. The <strong>Saginaw</strong> <strong>County</strong> Public Works Commissioner is hereby<br />

directed to obtain and to submit to this Board, for approval,<br />

plans and specifications and estimates of cost for the Project<br />

requested by the Township in its resolution addressed to the<br />

<strong>County</strong>, and to negotiate and to submit to this Board, for<br />

approval, a contract between the <strong>County</strong> and the Township in<br />
