II.On page III-44, the Fees section will refer to pages III-41<br />

through III-43 and the reference to III-40 through III-43<br />

will be deleted. The page numbers referenced on III-45 in<br />

Step 1 will be replaced with page number III-41 through III-<br />

43.<br />

III.On page III-50, the following paragraph will be added, “A<br />

proposed facility must be located on land which has the<br />

zoning designation as outlined on pages III-53 through III-54<br />

in order to be consistent with this Plan. The remaining<br />

columns on pages III-51 through III-54 are for information<br />

purposes only and are not siting criteria. Compliance with<br />

the other siting concerns expressed on these pages will not<br />

be evaluated and is not necessary to be consistent with the<br />

Plan. City, village, or township zoning approval is not<br />

permitted as a requirement for plan consistency under Part<br />

115.”<br />

IV.On page III-46, the first sentence under the Note under Step 4<br />

will be changed to read, “If the TRC does not meet within ten<br />

(10) days after receipt of the applicant’s supplementary<br />

package addressing deficient material of fails to make a<br />

certification of whether or not the applicant package is<br />

complete within the time frame identified in Step 4, the<br />

package is automatically complete and will be forwarded to<br />

the SRC for review.”<br />

V.On page III-46, under Step 5 of the Siting Process, the<br />

following sentences will be deleted, “The results of the<br />

local zoning review must be available in time for<br />

presentation at the public hearing in order to be considered.<br />

Local zoning review must address criteria from the local<br />

ordinance or this plan. The following tables identify key<br />

criteria from each local zoning ordinance as they were known<br />

to the DPA at the time of plan preparation. The DEQ will not<br />

accept a local zoning denial by itself as justification for<br />

not siting a solid waste disposal facility.”<br />

VI.On page III-47, the following sentence will be added to the<br />

first paragraph that states, “If the BOC is unable to arrive<br />

at a determination of consistency within ninety (90) days,<br />

the proposal will be considered consistent by the <strong>County</strong> with<br />

the Plan.”<br />

VII.On page III-48, the following sentence, “If the Site Review<br />

Committee determines that a proposed site is in compliance<br />

with the Plan, they will notify the applicant, the <strong>Saginaw</strong><br />

<strong>County</strong> Health Department and the Michigan Department of<br />

Environmental Quality that the proposed site is in compliance<br />

with the <strong>Saginaw</strong> <strong>County</strong> Solid Waste Management Plan.” will be<br />

replaced with, “If the BOC determines that a proposed site is<br />

in compliance with the Plan, the DPA will notify the<br />

applicant, the <strong>Saginaw</strong> <strong>County</strong> Health Department and the<br />
