JUDICIAL NOTICE<br />

In recent years, there has been an increasing trend of<br />

violence directed against courts and governmental agencies.<br />

Incidents of violence have occurred in court facilities throughout<br />

Michigan and the United States involving various sized jurisdictions.<br />

The threat of violent acts has given rise to an urgent need<br />

to implement protective measures to secure the court facilities in<br />

<strong>Saginaw</strong> <strong>County</strong> and protect the vital governmental interest of<br />

providing justice.<br />

Therefore, in accordance with the Michigan Supreme Court's<br />

Administrative Orders 1998-5 and specifically <strong>2001</strong>-1 and in<br />

compliance with <strong>Saginaw</strong> <strong>County</strong> Board of Commissioners Resolution C<br />

adopted on June 26, <strong>2001</strong>, the 10th Judicial Circuit, the 70th<br />

District Court and the <strong>Saginaw</strong> <strong>County</strong> Probate Court hereby execute<br />

the following Order:<br />

ORDER TO PROHIBIT WEAPONS AND CONDUCT SEARCHES<br />

At a session of said Court held in <strong>Saginaw</strong>, Michigan<br />

on the 2nd day of July, <strong>2001</strong><br />

IT IS HEREBY ORDERED that no weapons are allowed in the<br />

<strong>Saginaw</strong> <strong>County</strong> Courthouse and the Juvenile Center located on<br />

Hospital Road, except for law enforcement officers on duty in the<br />

courthouse;<br />

IT IS FURTHER ORDERED that all persons, unless specifically<br />

excepted, and all of their parcels and possessions entering either<br />

the <strong>Saginaw</strong> <strong>County</strong> Courthouse or the Juvenile Center located on<br />

Hospital Road are subject to being searched by Sheriffs Deputies<br />

for the purpose of keeping weapons, explosives and other<br />

restricted items from entering at any time while in the facility.<br />

Deputies shall have the authority to frisk or search individuals<br />

for weapons at random;<br />

IT IS FURTHER ORDERED that the degree of intrusiveness and<br />

length of the search shall be limited and no more intrusive than<br />

necessary to protect against the dangers presented by restricted<br />

items. The degree and length of the search shall be based upon<br />

articulable, reasonable suspicions that the person or object being<br />

searched may reveal a weapon or restricted item;<br />

IT IS FURTHER ORDERED that signs shall be posted outside the<br />

buildings announcing that "All weapons are prohibited from this<br />

facility. All persons and their parcels entering the building and<br />

courtrooms are subject to a search for weapons and restricted<br />

items as a condition of entry;"<br />

IT IS FURTHER ORDERED that Deputies shall confiscate any<br />

weapon found during a search. Any person found to possess a weapon<br />
