AUTHORIZING NOT TO EXCEED $1,725,000 SAGINAW COUNTY WATER SUPPLY<br />

AND SEWAGE DISPOSAL SYSTEM BONDS (CITY OF FRANKENMUTH)<br />

(GENERAL OBLIGATION LIMITED TAX)<br />

A RESOLUTION PROVIDING FOR THE ISSUANCE OF BONDS TO DEFRAY COSTS<br />

OF WATER SUPPLY AND SEWAGE DISPOSAL SYSTEM IMPROVEMENTS;<br />

PROVIDING FOR THE PAYMENT AND SECURITY OF SAID BONDS; AND<br />

PROVIDING FOR OTHER MATTERS RELATIVE TO SAID BONDS AND THE<br />

SECURITY THEREFOR.<br />

Minutes of a regular meeting of the Board of Commissioners of<br />

the <strong>County</strong> of <strong>Saginaw</strong>, Michigan, held in said <strong>County</strong> on the 14th<br />

day of August, <strong>2001</strong>, at 5:00 o’clock p.m., Eastern Daylight<br />

Savings Time.<br />

PRESENT: Members - Raymond F. Bartels, Thomas A. Basil, Robert D.<br />

Blaine, Jeanine A. Collison, Robert L. Fish, Eddie F. Foxx, James<br />

M. Graham, Todd M. Hare, Kenneth B. Horn, Richard F. Mallette,<br />

Michael P. O'Hare, Carl E. Ruth, Connie D. Smith, Robert M. Woods<br />

Jr., Patrick A. Wurtzel<br />

ABSENT: Members - None<br />

The following preamble and resolution were offered by Member Hare<br />

and supported by Member Horn:<br />

WHEREAS, the <strong>County</strong> of <strong>Saginaw</strong> (the “<strong>County</strong>”), acting by and<br />

through its Board of Commissioners and pursuant to the authority<br />

conferred upon it by Act 185, Public Acts of Michigan, 1957, as<br />

amended (the “Act”), did, by resolution duly adopted by a twothirds<br />

(2/3) vote of the members-elect of said Board of<br />

Commissioners, establish a Department of Public Works in and for<br />

the <strong>County</strong> for the administration of the powers conferred upon the<br />

<strong>County</strong> by said Act; and<br />

WHEREAS, pursuant to the authorization of Section 2 of the<br />

Act, the Public Works Commissioner of the <strong>County</strong> (the<br />

“Commissioner”) administers said Department of Public Works; and<br />

WHEREAS, the <strong>County</strong> pursuant to the Act and this resolution<br />

will establish the <strong>Saginaw</strong> <strong>County</strong> Water Supply and Sewage<br />

Disposal System (City of Frankenmuth) (the “System”); and<br />

WHEREAS, the <strong>County</strong>, by and through the Commissioner, and the<br />

City of Frankenmuth (the “Local Unit”) have entered into a<br />

contract (the “Contract”) for the acquisition, construction and<br />

financing of certain improvements to the System (the “Project”),<br />

which Contract is attached hereto and made a part of this<br />

resolution; and<br />

WHEREAS, the Contract has been duly approved by order of the<br />

Commissioner and resolution of the legislative body of the Local<br />

Unit and has been fully executed by the parties thereto; and<br />

WHEREAS, plans, specifications and estimates of cost of the<br />

Project have been prepared by Spicer Group Inc., consulting<br />

engineers of <strong>Saginaw</strong>, Michigan, and Advocate Engineering ,<br />

consulting engineers of Frankenmuth, Michigan, and have been duly<br />

approved by the Commissioner; and<br />
