Board of Commissioners May 22, <strong>2001</strong><br />

Part of Government Lot 2 of Section 9, Township 9 north, Range 3<br />

East, Village of Chesaning, <strong>Saginaw</strong> <strong>County</strong>, Michigan.<br />

Described as beginning at a point which is N 89° 48' 48" W<br />

along said East-West 1/4 line, 861.18 feet from the East 1/4<br />

corner of said section; thence continuing N 89° 48' 48" W<br />

along said East-West 1/4 line, 1025.33 feet to a point on the<br />

Easterly right of way line of Sharon Road; thence N 03° 14'<br />

20" E along said right way of line, 200.28 feet; thence S 89°<br />

48' 48" E parallel with said East-West 1/4 line, 902.40 feet<br />

to a point on the Westerly bank of the Shiawassee River;<br />

thence on a traverse line along the Westerly bank of the<br />

Shiawassee River the following one course: (1) S 29° 07' 12"<br />

E, 229.36 feet to the point of beginning, including that land<br />

lying between the above described traverse line and the<br />

Shiawassee River containing 4.4 acres within the traversed<br />

area.<br />

The above described legal description was written from recorded<br />

documentation only, no field work has been performed at this<br />

time.<br />

WHEREAS, It further appearing that a public hearing, in<br />

accordance with the requirements of MSA 5.1470, was held on the<br />

Petition on Tuesday, May 22, <strong>2001</strong>, at which time all parties<br />

interested were heard concerning the proposed boundaries of the<br />

Village and that proof of publication of a notice of the hearing<br />

has been filed with the <strong>Saginaw</strong> <strong>County</strong> Clerk to the effect that<br />

the Notice was published for three consecutive weeks in the<br />

Tri-<strong>County</strong> Citizen, a weekly newspaper, printed, published and<br />

circulated within <strong>Saginaw</strong> <strong>County</strong> and within the Village of<br />

Chesaning, prior to the date of hearing, and the Board having<br />

given the Petition due consideration and being fully and duly<br />

advised in the premises.<br />

NOW THEREFORE, BE IT RESOLVED, It is hereby ordered and<br />

determined that the prayer contained in the Petition is granted<br />

and the Village of Chesaning shall be permitted to annex and alter<br />

its boundaries to incorporate lands and premises described above.<br />

BE IT FURTHER RESOLVED, It is further ordered and determined<br />

that from and after this date that boundaries of the Village of<br />

Chesaning shall be fixed and shall exist as provided by this Order<br />

taking into the Village the lands and parcels described above.<br />

BE IT FURTHER RESOLVED, It is further ordered and determined<br />

that this Order be entered upon the records of the Board of <strong>County</strong><br />

Commissioners of the <strong>County</strong> of <strong>Saginaw</strong> and that the <strong>Saginaw</strong> <strong>County</strong><br />

Clerk shall be, and she hereby is, authorized and directed to<br />

transmit certified copies of this Determination and Order to the<br />

Village Clerk of the Village of Chesaning and to the Secretary of<br />

State of the State of Michigan.<br />
