Principles in the law on environmentThe new Law on Environment was adopted in July 2005 as the mostimportant law in the area of environment in the Republic of Macedonia.It is the basic law in this area, which assumes that other laws in this areashould be aligned with it. The Law on Environment is compliant with therequirements of the European Union. Its basic postulate concernspreservation, protection, recovery and improvement of the environment,as one of the fundamental values recognized in the Constitution of theRepublic of Macedonia.Chapter of particular relevance for this paper is the second, Chapterof the Law, regarding the principles of environmental protection. Theyset the frame for further provisions of the Law: principle of high level ofprotection, principle of integration, principle of sustainable development,polluter pays principle, user pays principle, principle of subsidiarity,principle of proportionality, principle of precaution, principle ofprevention, principle of cleaner production, principle of internationalcooperation, public participation and access to information principle andprinciple of public environmental awareness rising.This Chapter also hosts the „safeguard clause”, which is not aprinciple, but enables the state to undertake measures for environmentprotection in emergency cases. Namely, Article 19 specifies that “For thepurposes of protection of human life and health and the environment, thebodies of the central government and the bodies of the municipalities andof the City of Skopje and of the municipalities of the City of Skopjeshall, in accordance with the law, have both the right and the obligationto undertake measures and activities related to the temporary or the permanentprohibition of the performance of certain activities, or on thetrade in certain products.”ConclusionsBased on the results obtained, we may conclude that theConstitution of the Republic of Macedonia is a modern constitutionestablishing the grounds for building the policy for environment andnature protection and improvement.
