L'article 4 de l'Unfair Competition Prevention and Trade Secret Protection Act accorde le
droit à toute personne lésée ou qui pourrait l'être par un acte de concurrence déloyale de porter
plainte devant un tribunal:
(1) Any person whose business profit is or might be infringed by any unfair competitive act, may
file a claim before a court for the prohibition or prevention of such unfair competitive act
against a person committing or attempting to do such act.
(2) When the person files the claim referred to in paragraph (1), he also may file a claim for the
disposal of goods that has caused the unfair competitive act, the removal of facilities that are
used for the unfair competitive act, the cancellation of the registration of the domain name
subject to the unfair competitive act and measures necessary to ban or prevent the unfair
competitive act.
Les consommateurs ont aussi le droit d'intervenir auprès de la Fair Trade Commission en
vertu du Fair labeling and advertising act et de l'Enforcement decree of the fair labelling and
advertising act.
c) Etendue de la protection des signes nationaux
Il est interdit d'enregistrer des marques, en rapport avec des biens ou des services, qui sont
identiques ou similaires au drapeau ou à l'emblème national. La loi ne donne pas d'autres
précisions.
d) Protection des signes nationaux
Les signes nationaux de la Corée du sud sont protégés de trois façons:
1) Interdiction d'enregistrement
Il est interdit d'enregistrer des marques, en rapport avec des biens ou des services 411 ,
identiques ou similaires au drapeau ou à l'emblème national:
[…] trademark registration may not be obtained in the following cases:
(i) trademarks which are identical with, or similar to, the national flag, the national emblem,
colors, medals, decorations or badges of the Republic of Korea; the national flags or emblems of
foreign nations; medals, decorations or badges of the countries party to the Paris Convention
for the Protection of Intellectual Property (hereinafter referred to as "Paris Convention") or a
member of the World Trade Organization, or a contracting party to the Trademark Law Treaty;
the titles or marks of the Red Cross; Olympic or well-known international organizations; or
those which are identical with, or similar to, seals or signs of the Republic of Korea or the
countries party to the Paris Convention, or a member of the World Trade Organization, or a
contracting party to the Trademark Law Treaty; or the public organizations thereof, used for
indicating supervision or certification 412.
