A mark which either consists of or comprises<br />

the flag, coat of arms or other insignia of<br />

Switzerland or which disparage, falsely<br />

suggest a connection with, or bring into<br />

contempt or disrepute any Swiss national<br />

symbol will not be registrable under U.S.<br />

trademark law.<br />

Wilful use as a trade mark, commercial label,<br />

or portion thereof, or as an advertisement or<br />

insignia for any business or organization or<br />

for any trade or commercial purpose, of the<br />

coat of arms of the Swiss Confederation,<br />

consisting of an upright white cross with<br />

equal arms and lines on a red ground, is<br />

punishable by fine or imprisonment for not<br />

more than six months, or both.<br />

The Swiss national flag and arms are<br />

specifically protected from registration as<br />

trade marks. Their use in other contexts is<br />

restricted by law only if it creates a false and<br />

misleading impression that a business or<br />

product is associated with Switzerland.<br />
