(iv) trademarks which are identical with, or similar to, the Red Cross ensign on a white ground<br />

or the title Red Cross or Geneva Cross;<br />

(v) trademarks comprising a mark identical with, or similar to, an official seal or sign which<br />

indicates supervision or certification by the Government of Japan or by the Government of a<br />

country party to the Paris Convention or a Member of the World Trade Organization, or by a<br />

local public entity and which has been designated by the Minister of International Trade and<br />

Industry, which are used on goods or services identical with, or similar to, the goods or services<br />

in respect of which such seal or sign is used;<br />

(vi) trademarks which are identical with, or similar to, a famous mark indicating a State or a<br />

local public entity or an agency thereof or a non-profit organization or enterprise working in the<br />

public interest.<br />

Nous avons indiqué plus haut (voir 3.d) que le Japon n'enregistre pas les indications<br />

géographiques en vertu de l'article 3.1.III de la Trademark law. Mais on ne peut faire usage de<br />

telles indications si elles sont trompeuses.<br />

2) Interdiction d’usage<br />

Il est interdit de faire usage de signes identiques ou similaires à l'enseigne d'organisation<br />

internationale ou à des drapeaux ou des emblèmes de pays étrangers avec lesquels le Japon est<br />

lié par un traité à titre de marques pour des biens ou des services. Cette interdiction est prévue<br />

par les articles 9 et 10 de Unfair Competition Prevention Law, sauf autorisation de ces<br />

organisations ou de ces pays:<br />

Article 9 - (1) No one may use, as a trademark, a mark identical to the national flag or coat of<br />

arms of a foreign state or any other insignia which is prescribed by an ordinance of the Ministry<br />

of International Trade and Industry (all such insignias hereinafter referred to as a “national<br />

emblem” ) or a mark similar to a national emblem (such identical or similar emblem hereinafter<br />

referred to as a “quasi-emblem” ), or may assign, deliver, display for the purpose of assignment<br />

or delivery, export or import goods using a quasi-emblem as a trademark, or offer a service<br />

using a quasi-emblem as a trademark; provided, however, that this does not apply in the case<br />

where permission has been obtained from the government agency of the foreign state which is<br />

vested with the authority to grant permission (including, in this case and hereinafter,<br />

administrative measures similar to permission) for use of the national emblem of that state.<br />

(2) In addition to the provisions stipulated in the above paragraph, no one may use, in a manner<br />

which is likely to cause misleading of the place of origin of goods, the coat of arms of a foreign<br />

state prescribed by an ordinance of the Ministry of International Trade and Industry referred to<br />

in the above paragraph (hereinafter referred to as a “coat of arms” ), or may assign, deliver,<br />

display for the purpose of assignment or delivery, export or import goods using a coat of arms,<br />

or offer a service using a coat of arms; provided, however, that this does not apply in the case<br />

where permission has been obtained from the government agency of the foreign state which is<br />

vested with the authority to grant permission to use the coat of arms of that state.<br />

(3) No one may use a mark identical to a seal or sign of a foreign state or regional public entity<br />

used for certification or inspection purposes, which is prescribed by an ordinance of the<br />

Ministry of International Trade and Industry (hereinafter referred to as a “government sign” )<br />

or a similar mark (such identical or similar mark hereinafter referred to as a “quasigovernmental<br />

sign” ) as a trademark on goods or for a service identical or similar to goods or<br />

service for which such government sign is used, or may assign, deliver, display for the purpose<br />

of assignment or delivery, export or import goods using a quasi-governmental sign as a<br />

trademark, or offer a service using a quasi-governmental sign as a trademark; provided,<br />
