4 LEAVETo enable the <strong>Department</strong> to determine whether a staff member's service is warservice or special service, the staff member shall supply to the <strong>Department</strong> aservice record from the <strong>Department</strong> <strong>of</strong> Defence.4.5.11.2 Criteria for Continuous Service: Schedule 3A <strong>of</strong> the Public Sector Employment<strong>and</strong> Management Act 2002b) For the purpose <strong>of</strong> Schedule 3A <strong>of</strong> the Public Sector Employment <strong>and</strong>Management Act 2002 service shall be deemed to be continuous under thefollowing circumstances:if the staff member entered on duty with the <strong>Department</strong> within twomonths following cessation <strong>of</strong> <strong>employment</strong> with the former declaredemployer; orif the earlier period comprises full-time war service as a member <strong>of</strong> theAustralian Defence Force, as defined in clause 4 (2) <strong>of</strong> Schedule 3A <strong>of</strong>the Public Sector Employment <strong>and</strong> Management Act 2002, <strong>and</strong><strong>employment</strong> with the <strong>Department</strong> commenced within twelve monthsafter ceasing service with the armed forces.4.5.12 PAYMENT OF ACCRUED EXTENDED LEAVE4.5.12.1 Payment in AdvancePayment <strong>of</strong> accrued extended leave shall be made in advance for leave taken if thestaff member so requests but payment shall be subject to the usual provisions inrespect <strong>of</strong> pay in advance as determined by the Treasurer from time to time.4.5.12.2 Double Pay Extended LeaveA staff member with an entitlement to extended leave may elect to take leave atdouble pay. The additional payment will be made as a non-superable taxableallowance payable for the period <strong>of</strong> the absence from work. The staff member’sleave balance will be debited for the actual period <strong>of</strong> the absence from work <strong>and</strong> anequivalent number <strong>of</strong> days as are necessary to pay the allowance.For example, a staff member with an extended leave balance <strong>of</strong> 50 working dayswishing to take extended leave at double pay may take 25 working days leave fromwork, reducing their extended leave balance to 25 days. A further 25 working dayswill be debited from the staff member’s balance to cover payment <strong>of</strong> the nonsuperabletaxable allowance.Other leave entitlements eg recreation leave, vacation pay, sick leave <strong>and</strong> extendedleave, will accrue at the single time rate where a staff member takes extended leaveon double pay.Superannuation contributions will only be made on the basis <strong>of</strong> the actual absencefrom work ie at the single time rate.Where a staff member elects to take extended leave at double pay, in most cases aminimum period <strong>of</strong> absence <strong>of</strong> one week should be taken ie one week leave utilisingtwo weeks <strong>of</strong> accrued leave.4.5.12.3 Staff Member to be Paid Monetary Value on TerminationH<strong>and</strong>book for non teaching staff in schools 2007 Page 4 - 31
