4 LEAVEa) the monetary value <strong>of</strong> the sick leave must be claimed as part <strong>of</strong> the claim forcompensation or damages <strong>and</strong> is to be included in any assessment <strong>of</strong> damagesor compensation;b) the monetary value <strong>of</strong> the sick leave must be repaid to the <strong>Department</strong> once theclaim for compensation or damages has been paid; <strong>and</strong>c) the undertaking must be signed <strong>and</strong> returned to the <strong>Department</strong> as soon aspracticable.4.11.15.3 Leave OptionsA staff member may elect to take:a) available sick leave; <strong>and</strong>/orb) recreation (if applicable) or extended leave to credit; <strong>and</strong>/orc) leave without pay;when absences occur as a result <strong>of</strong> injury or illness <strong>and</strong> a claim for compensation ordamages has been made.4.11.15.4 Provision <strong>of</strong> InformationIf information is requested from the <strong>Department</strong> by the staff member or his or herlegal representative, the <strong>Department</strong> is obliged to provide an accurate statement <strong>of</strong>the total salary or wage that would have been received had the staff member beenon duty, including leave payments made for the period <strong>of</strong> incapacity.4.11.15.5 Refusal <strong>of</strong> ClaimWhere a claim is refused, normal sick leave provisions are to apply.4.11.15.6 Refund <strong>of</strong> LeaveWhere a staff member has refunded the monetary value <strong>of</strong> sick leave granted, thesick leave will be recredited. The period <strong>of</strong> absence resulting from the injury orillness is then regarded as special leave without pay but counts as service for theaccrual <strong>of</strong> all types <strong>of</strong> leave.4.11.15.7 Other LeaveWhere the staff member has taken recreation <strong>and</strong>/or extended leave he or she may,upon receipt <strong>of</strong> compensation elect:a) to repay the monetary value <strong>of</strong> the recreation <strong>and</strong>/or extended leave taken <strong>and</strong>have the leave recredited; orb) not to repay it, in which case the leave remains as a debit.H<strong>and</strong>book for non teaching staff in schools 2007 Page 4 - 59
