4 LEAVEThe on loan arrangements apply strictly as negotiated <strong>and</strong> no extra claims in respect<strong>of</strong> the period <strong>of</strong> on loan are to be made on the <strong>Department</strong> by the trade union or thestaff member.4.15.3 EMPLOYEE REPRESENTATIVE ACTIVITIES4.15.3.1 GeneralThe grant <strong>of</strong> special leave to engage in employee representative activities:a) is at <strong>Department</strong>al convenience;b) must be confined to a minimum <strong>of</strong> number <strong>of</strong> staff members;c) is for the minimum necessary period;d) is dependent on an application being made to the <strong>Department</strong> in advance;e) is payable at the base rate <strong>of</strong> pay (including, if appropriate, relevant allowancesthat would normally be paid on that day);f) is not to incur liability by the <strong>Department</strong> in fares, overtime, travellingcompensation, travelling <strong>and</strong> sustenance allowances, meal money, <strong>and</strong> so on;<strong>and</strong>g) is not extended beyond the st<strong>and</strong>ard hours for the staff member for that day.4.15.3.2 Availability4.15.4 INDUSTRIAL ACTION4.15.4.1 GeneralSpecial leave is available for the following purposes.a) Local meetings between employee representatives <strong>and</strong> management.b) Attendance as a witness on behalf <strong>of</strong> employee associations or <strong>of</strong> employeesbefore an industrial tribunal. Staff members who attend as witnesses beforeindustrial tribunals are granted special leave for such a period as is necessary forthem to give evidence. They should return to duty as soon as their evidence hasbeen given unless required by the tribunal to remain in attendance.c) Conciliation committee members: – Staff members appointed as members <strong>of</strong> aConciliation Committee or as alternate members under the provisions <strong>of</strong> theIndustrial Relations Act 1996, may be granted special leave <strong>of</strong> absence duringst<strong>and</strong>ard hours for the period they are engaged.Provisions <strong>of</strong> the Industrial Relations Act 1996 apply to the right <strong>of</strong> union members totake lawful industrial action.H<strong>and</strong>book for non teaching staff in schools 2007 Page 4 - 84
