4 LEAVE4.17.5 LEAVE ENTITLEMENTSAccident leave accrues full leave entitlements provided that the period <strong>of</strong> incapacity is coveredby a valid medical certification.4.17.6 PUBLIC HOLIDAYSNormal salary plus compensation is paid for public holidays occurring during a period for whichworkers’ compensation has been authorised.4.17.7 INCREMENTAL PROGRESSIONAll accident leave accrues service for incremental salary progression as if the staff memberwere on duty.4.17.8 PERMANENT INCAPACITYA staff member who is on accident leave but as a result <strong>of</strong> the illness or injury is permanentlyunfit to work, may be medically retired. See Chapter 8, Separation from the Service for furtherdetails.New legislative changes have curtailed access to the commutation <strong>of</strong> long term workers’compensation claims. For most claims that occur in association with the <strong>Department</strong>’s workers’compensation system prior arrangements available for commutation will not apply. Furtherdetails can be found in section 87EA <strong>of</strong> the Workers Compensation Act 1987.4.17.9 REFUSAL OF CLAIMWhere a workers’ compensation claim is refused but the <strong>Department</strong> is satisfied that the staffmember is unfit for duty, the staff member is eligible to be granted paid sick leave to credit,followed by recreation leave (if applicable), extended leave or sick leave without pay.4.17.11 PERMANENTLY MODIFIED DUTIESAfter a significant period <strong>of</strong> rehabilitation <strong>and</strong> treatment a staff member’s treating doctor maydetermine that they require permanent modifications to their work. The staff support <strong>of</strong>ficer <strong>and</strong>rehabilitation provider will work together to modify the employee’s job <strong>and</strong> if this is not suitablethey will work together to source an alternate suitable position.
