4 LEAVE4.2.4.7 Notification <strong>of</strong> birthAs soon as feasible after the birth, a staff member should send a copy <strong>of</strong> the child’sbirth certificate to the <strong>Department</strong>. A staff member may elect to provide an extract <strong>of</strong>the birth certificate indicating the details <strong>of</strong> the mother <strong>and</strong> child only.4.2.4.8 Other Leave in Conjunction with Maternity Leavea) A staff member may use available sick leave with pay, sick leave withoutpay, family <strong>and</strong> community service leave or extended leave if, because <strong>of</strong> acomplication associated with the pregnancy, including a history <strong>of</strong>miscarriage or other illnesses the staff member is unable to continue to work.An application made under this section must be supported with a medicalcertificate <strong>and</strong> will not affect right <strong>of</strong> return. (See Section 4.2.6.8)b) Sick leave to credit may be granted until the anticipated date <strong>of</strong> birth onwhich date maternity leave will commence.c) Staff members eligible for extended leave may apply to use extended leaveto supplement a period <strong>of</strong> half pay maternity leave or unpaid maternity leave<strong>and</strong> should indicate their requirements in the application for leave. Doublepay extended leave may only be taken concurrent with unpaid maternityleave.4.2.4.9 Absent on Other Leavea) If a staff member is absent on leave without pay <strong>and</strong> applies for maternityleave but does not resume duty, maternity leave will be approved if theanticipated date <strong>of</strong> birth is due to occur after the expiry date <strong>of</strong> the leave.b) If a staff member is on leave without pay <strong>and</strong> the anticipated date <strong>of</strong> birth isto occur prior to the expiry date <strong>of</strong> that leave, then the period from the datethe staff member advises <strong>of</strong> her pregnancy until the actual date <strong>of</strong> birth willbe converted to leave without pay for maternity purposes. From the actualdate <strong>of</strong> birth the staff member will be granted a period <strong>of</strong> not more than 24months unpaid maternity leave.4.2.4.10 Subsequent Pregnancy While on Maternity LeaveWhere a female staff member becomes pregnant whilst on maternity leave, a furtherperiod <strong>of</strong> maternity leave shall be granted if requested. Whether leave will be paid orunpaid will depend on the completion <strong>of</strong> the 40 weeks qualifying period (see sections4.2.4.1 <strong>and</strong> 4.2.6.4) <strong>and</strong> whether the staff member has accessed additionalentitlements.If the female staff member enters on the second period <strong>of</strong> maternity leave during thecurrency <strong>of</strong> the initial period <strong>of</strong> maternity leave, then any residual maternity leavefrom that initial entitlement ceases.See Section 4.2.6 GENERAL CONDITIONS for details <strong>of</strong> other aspects <strong>of</strong> leave <strong>and</strong> payment.H<strong>and</strong>book for non teaching staff in schools 2007 Page 4 - 9
