4 LEAVE4.2.6.3 Right to requestto resume duty, they must either confirm in writing that they will be resumingduty, or apply for an extension <strong>of</strong> leave, or if resigning, submit notice <strong>of</strong>separation.The following provisions are in addition to the basic entitlement provided in sections4.2.3.1, 4.2.4.1 <strong>and</strong> 4.2.5.1 <strong>and</strong> apply to any staff member who takes, or is on,adoption, maternity or parental leave on or after 19 December 2005.a) A staff member, making an application for the basic entitlement to adoption,maternity or parental leave may also make a request to:(i)(ii)extend the period <strong>of</strong> unpaid adoption, maternity or parental leave for afurther continuous period not exceeding 12 months from the child’sfirst birthday;return to work on a part time basis until the child reaches school agethrough accessing part time adoption, maternity or parental leave.b) The <strong>Department</strong> shall consider the request having regard to the staffmember’s circumstances <strong>and</strong>, provided the request is genuinely based on thestaff member’s parental responsibilities, may only refuse the request onreasonable grounds related to the effect on the workplace or the<strong>Department</strong>’s business. Such grounds might include cost, lack <strong>of</strong> adequatereplacement staff, loss <strong>of</strong> efficiency <strong>and</strong> the impact on customer service.c) Where a staff member wishes to make a request under this section, such arequest must be made as soon as possible but no less than 7 weeks prior tothe date upon which the staff member is due to return to work from leave.Staff members are encouraged to apply for access to all entitlements underthis clause at the time <strong>of</strong> making their original application for adoption,maternity or parental leave.d) The staff member’s request should be submitted via the <strong>Department</strong>’selectronic leave system or by submission <strong>of</strong> a paper based application. Incertain circumstances staff members may be asked to provide detailssupporting their request under this provision. In such cases, the staffmember’s request <strong>and</strong> the <strong>Department</strong>’s decision under this section must berecorded in writing.e) Where a staff member has resumed duty after a period <strong>of</strong> leave, anapplication may be made under this clause <strong>and</strong> will be subject toconsideration on a case by case basis.4.2.6.4 Determining paymentsa) Subject to the completion <strong>of</strong> 40 weeks continuous service, eligible permanent<strong>and</strong> temporary staff members are paid:- adoption, maternity <strong>and</strong> parental leave at the long term temporaryrate (1.058 times the permanent rate);- SAS staff whose adoption or maternity leave abuts the summervacation will be able to commence their adoption or maternity leave, be paidtheir accrued recreation leave (including leave loading) <strong>and</strong> public holidaysH<strong>and</strong>book for non teaching staff in schools 2007 Page 4 - 14
