4 LEAVE4.11.4 EXHAUSTION OF PAID SICK LEAVE4.11.4.1 Election to Use Other Paid Leave or Proceed on Sick Leave Without PayWhere all paid sick leave entitlements for which a staff member is eligible have beenexhausted, they may elect to:a) use part or all <strong>of</strong> any recreation, if applicable, <strong>and</strong>/or extended leave credits; orb) to proceed onto sick leave without pay.4.11.4.2 Former Ministerial Staff MembersA staff member with former ministerial service who has exhausted all other sick leaveentitlements, may be granted the sick leave remaining to credit as at the last day <strong>of</strong>ministerial service providing that:a) the staff member has had one or more years <strong>of</strong> continuous service as aministerial staff member with a department listed in Schedule 1 <strong>of</strong> the PublicSector Employment <strong>and</strong> Management Act 2002; <strong>and</strong>b) there was no break between such service <strong>and</strong> service under the Public SectorEmployment <strong>and</strong> Management Act 2002, Public Sector Management Act 1988 orthe Public Service Acts <strong>of</strong> 1902 <strong>and</strong> 1979.4.11.4.3 Sick Leave Without Pay to Count as ServiceSick leave without pay counts as service for the accrual <strong>of</strong>:a) recreation leave;b) extended leave (for periods <strong>of</strong> sick leave no pay <strong>of</strong> less than six months);c) further sick leave with pay, provided such leave shall not be granted during thecurrency <strong>of</strong> the sick leave without pay; <strong>and</strong>d) vacation pay <strong>and</strong> st<strong>and</strong> down pay.4.11.5 SICK LEAVE WHILST ON EXTENDED OR RECREATION LEAVE4.11.5.1 Recredit <strong>of</strong> LeaveA staff member who becomes ill while on recreation (if applicable) or extended leave,<strong>and</strong> who has sick leave to credit, may have the period <strong>of</strong> leave during which theillness occurred, recredited subject to the staff member:a) contacting the Director-General at the earliest opportunity, notifying details <strong>of</strong> thesituation; <strong>and</strong>b) providing a medical certificate issued by a registered medical practitioner whichclearly states the nature <strong>and</strong> duration <strong>of</strong> the illness. Any certificate provided thatis not written in English shall be accompanied by a certified translation.H<strong>and</strong>book for non teaching staff in schools 2007 Page 4 - 52
