4 LEAVE4.7.3 OTHER FORMS OF LEAVE WITHOUT PAYThere are other forms <strong>of</strong> leave (such as military, sick <strong>and</strong> study leave) which can be grantedwithout pay. See Section 4.7.8 for a summary <strong>of</strong> the effects <strong>of</strong> leave without pay onentitlements.4.7.4 RIGHT OF RETURN4.7.4.1 Leave Without Pay up to Twelve MonthsFor leave up to <strong>and</strong> including a period <strong>of</strong> twelve months, staff members have a right<strong>of</strong> return to the same school at the same classification <strong>and</strong> number <strong>of</strong> hours perweek, subject to the normal staffing operation procedures.4.7.4.2 Leave Without Pay in Excess <strong>of</strong> Twelve MonthsApproximately eight weeks prior to the conclusion <strong>of</strong> periods <strong>of</strong> full time leave withoutpay exceeding twelve months, staff will be contacted by Employee Services Bathurstto ascertain their intentions on conclusion <strong>of</strong> the leave. Staff should then completean application for transfer or advise what other action they wish to take.Staff members who wish to return to work will have their transfer applicationsprocessed in accordance with normal staffing operation procedures.Please Note: The <strong>Department</strong> <strong>of</strong> <strong>Education</strong> <strong>and</strong> Training <strong>and</strong> the Public Service Association arecurrently discussing procedures regarding return to school after leave without pay in excess <strong>of</strong>12 months.4.7.5 CHANGES TO LEAVE ARRANGEMENTS4.7.5.1 New ApplicationA new application for leave without pay must be submitted for approval to vary anexisting part time or full time leave without pay arrangement.4.7.5.2 Premature ReturnThe Director-General may approve <strong>of</strong> staff members resuming from leave withoutpay prior to the expiration <strong>of</strong> the agreed leave. Staff members are expected toprovide sufficient notice <strong>of</strong> the intended date <strong>of</strong> return to duty so as to allow theschool time to make any necessary staffing <strong>and</strong> associated adjustments.4.7.5.3 Temporary Replacement StaffA person employed as a temporary replacement is to be informed, as part <strong>of</strong> thewritten advice concerning their <strong>employment</strong> arrangement prior to entry on duty, thattheir <strong>employment</strong> will be terminated on the return from leave without pay <strong>of</strong> theperson being replaced. They are also to be informed that their period <strong>of</strong> <strong>employment</strong>will be terminated if an approval is given under Section 4.7.6.3 Premature Return <strong>and</strong>any further period <strong>of</strong> <strong>employment</strong> in the <strong>Department</strong> is to be a separate arrangement.H<strong>and</strong>book for non teaching staff in schools 2007 Page 4 - 37
