4 LEAVEa) <strong>of</strong> their fitness or otherwise to return to duty;b) that no action in relation to the report will be taken until the medical appealsperiod expires; <strong>and</strong>c) that HealthQuest will notify the staff member <strong>of</strong> their appeal rights direct.4.11.14.3 No Appeal LodgedWhere no appeal is to be lodged <strong>and</strong> a written statement is obtained from the staffmember to that effect, then:a) that staff member may return to duty as soon as practicable if the medical reportstates that they are fit to resume duty; orb) the <strong>Department</strong> may institute proceedings for medical retirement where themedical report states that the staff member is unfit to continue in the service.4.11.14.4 Appeal LodgedWhere an appeal is to be lodged <strong>and</strong> no written statement to the contrary is obtained,no action shall be taken until either the appeal period has expired, or the appealproceedings have been finalised.4.11.14.5 Expiration <strong>of</strong> Appeal PeriodWhen the appeal period has expired or appeal proceedings have been finalised:a) the staff member shall be directed to resume duty forthwith; orb) the <strong>Department</strong> shall immediately institute proceedings for medical retirement;whichever is appropriate.4.11.14.6 Inquiries Regarding AppealsAll inquiries concerning rights <strong>of</strong> appeal should be directed to the AppealsCo-ordinator at HealthQuest (see Chapter 10 for details). Information is alsoavailable at: http://www.healthquest.gov.au/appeals.htm.4.11.15 ILLNESS OR INJURY NOT COVERED BY WORKERS' COMPENSATION4.11.15.1 GeneralWhere a staff member incurs an injury or illness <strong>and</strong> claims compensation ordamages other than under the Workers' Compensation Act, an undertaking <strong>and</strong> anauthority, in the form <strong>of</strong> Appendix A <strong>and</strong> Appendix B to this chapter should be signed<strong>and</strong> returned to the <strong>Department</strong> as soon as possible.4.11.15.2 Conditions Applying to Grant <strong>of</strong> Sick LeaveWhere it is not possible to obtain an undertaking, available sick leave may be grantedprovided the staff member is aware that:H<strong>and</strong>book for non teaching staff in schools 2007 Page 4 - 58
