4 LEAVE4.12.6 EMERGENCIESWhere a staff member is a witness <strong>and</strong> gives evidence regarding a traffic <strong>of</strong>fencealleged to have been committed by another staff member in the course <strong>of</strong> duty,special leave is to be granted to the witness for the period necessary to attend court.4.12.6.1 Emergency Volunteers <strong>and</strong> Volunteer Members <strong>of</strong> Safety OrganisationsWhere a staff member is a volunteer member <strong>of</strong>:Public Service Support Group;Volunteer Rescue Association <strong>of</strong> NSW (or affiliated groups);State Emergency Services;NSW Volunteer Fire Brigade;Rural Fire Service;Wireless Institute Civil Emergency Network;Cave Rescue Association;Volunteer Coastal Patrol;Bushwalkers' Federation;special leave <strong>of</strong> up to five days in any period <strong>of</strong> twelve months may be granted whencalled upon to assist as a volunteer <strong>of</strong> one <strong>of</strong> these organisations.4.12.6.2 Declared EmergenciesWhere a situation arises requiring a major operational response, or an emergency isdeclared under Section 44 <strong>of</strong> the Rural Fires Act 1997 or under other relevantlegislation or by the Premier, staff members who volunteer to assist are to be grantedspecial leave with no upper limit. Leave granted under this clause is not to counttowards the five days upper limit specified in Section 4.12.6.1 above.4.12.6.3 Pro<strong>of</strong> <strong>of</strong> Attendance at EmergenciesAn application for leave must be accompanied by a statement from the local orDivisional Controller, the Fire Controller, Deputy Fire Controller or the Police,certifying the times <strong>of</strong> attendance. The leave application should indicate the period<strong>and</strong> area <strong>of</strong> attendance together with the name <strong>of</strong> the organisation to which thevolunteer member belonged.4.12.6.4 Rest PeriodWhere a staff member remains on emergency duty for several days, the Director-General may grant special leave to allow the staff member reasonable time for restbefore returning to normal duties.Where a staff member does not remain on emergency duty for several days butassists in a rescue at such time as it would be unreasonable to expect the staffmember to report for duty at a normal time, up to one day's special leave for restpurposes may be granted.In the case <strong>of</strong> an emergency other than a declared emergency, this leave is to beincluded in the <strong>general</strong> limit <strong>of</strong> five days in any period <strong>of</strong> twelve months.H<strong>and</strong>book for non teaching staff in schools 2007 Page 4 - 64
