4 LEAVEbasis although not legally married to that staff member; orc) a child or an adult child (including an adopted child, a stepchild, a foster child oran ex nuptial child), parent (including a foster parent <strong>and</strong> legal guardian),gr<strong>and</strong>parent, gr<strong>and</strong>child or sibling <strong>of</strong> the staff member or spouse or de factospouse <strong>of</strong> the staff member; ord) a same sex partner who lives with the staff member as the de facto partner <strong>of</strong>that staff member on a bona fide domestic basis; ore) a relative <strong>of</strong> the staff member who is a member <strong>of</strong> the same household, wherefor the purposes <strong>of</strong> this paragraph:i) "relative" means a person related by blood, marriage, affinity orAboriginal kinship structures;ii) "affinity" means a relationship that one spouse, because <strong>of</strong> marriage,has to blood relatives <strong>of</strong> the other; <strong>and</strong>iii) "household" means a family group living in the same domesticdwelling.4.4.3.2 Short term temporary <strong>and</strong> casual staff members are entitled to not be available toattend work, or to leave work, if they need to care for a family member described inSection 4.4.3.1 above who:is sick <strong>and</strong> requires care <strong>and</strong> support, orrequires care due to an unexpected emergency, or the birth <strong>of</strong> a child.The staff member is not entitled to any payment for the period <strong>of</strong> non-attendance.4.4.3.3 The staff member shall, wherever practicable, give the principal notice prior to theabsence <strong>of</strong> the absence. If it is not reasonably practicable to give the principal ornominee prior notice, the staff member must, as soon as reasonably practicableduring the first day <strong>of</strong> such absence, inform the principal or nominee <strong>of</strong> theirinability to attend for duty.4.4.3.4 The principal <strong>and</strong> the staff member should discuss the period for which the employeewill be entitled to not be available to attend work, the reasons for taking suchabsence, the name <strong>of</strong> the person requiring care <strong>and</strong> that person's relationship to thestaff member. In the absence <strong>of</strong> agreement about the length <strong>of</strong> the absence, the staffmember is entitled to not be available to attend work for up to 48 hours (i.e. twodays) per occasion.4.4.3.5 The staff member shall, if required,a) establish either by production <strong>of</strong> a medical certificate or statutory declaration, theillness <strong>of</strong> the person concerned <strong>and</strong> that the illness is such as to require care byanother person, orb) establish by production <strong>of</strong> documentation acceptable to the Director-General or astatutory declaration, the nature <strong>of</strong> the emergency <strong>and</strong> that such emergencyresulted in the person concerned requiring care by the employee.H<strong>and</strong>book for non teaching staff in schools 2007 Page 4 - 23
