4 LEAVEHowever, unpaid adoption, maternity <strong>and</strong> parental leave shall not count asservice for determining incremental progression, except where increments basedon age must be paid on attainment <strong>of</strong> the appropriate age.b) Leave Creditsi) Maternity leave at full pay shall count as full service for the purpose <strong>of</strong>determining all forms <strong>of</strong> leave.ii)iii)Maternity leave at half pay shall count as service on a pro rata basis forthe purpose <strong>of</strong> determining all forms <strong>of</strong> leave. Maternity leave at halfpay is paid leave taken at a reduced rate <strong>and</strong> is not a combination <strong>of</strong> fullpay leave <strong>and</strong> leave without pay.Unpaid maternity leave shall not count as service for determining anyform <strong>of</strong> leave entitlement, except for extended leave in cases where atleast ten years <strong>of</strong> service has been completed <strong>and</strong> unpaid maternityleave does not exceed six months.4.2.6.8 Right <strong>of</strong> returnA permanent staff member’s right <strong>of</strong> return to their substantive position is retained ifthey resume duty 24 months (or earlier) after the actual date <strong>of</strong> birth <strong>of</strong> the child, or inthe case <strong>of</strong> adoption <strong>and</strong> parental leave if the total period <strong>of</strong> adoption/parental leave<strong>and</strong> any other leave is 24 months or less.4.2.6.9 SuperannuationA staff member accessing the basic or additional adoption, maternity or parental leaveentitlements, whether paid or unpaid, is not required to meet any payment <strong>of</strong> theemployer’s superannuation contributions to any NSW government superannuationfund. (See also Chapter 9 - Superannuation)4.2.6.10 Resignationa) The position <strong>of</strong> a permanent staff member who submits notice <strong>of</strong> resignationwhen proceeding on adoption, maternity or paternity leave will be declaredvacant. Resignation in this instance will not be accepted earlier than the lastday <strong>of</strong> the paid leave <strong>and</strong> not later than the last day <strong>of</strong> approved leave.b) Prior to submitting notice <strong>of</strong> resignation, consideration should be given to allother alternatives that may be available dependent on the staff member’slength <strong>of</strong> service <strong>and</strong> leave credits.
