1 GENERAL CONDITIONS OF EMPLOYMENT1.4 TRANSFERRED EMPLOYEES’ COMPENSATIONThe Crown Employees (Transferred Employees’ Compensation) Award provides eligible staffmembers with an entitlement to compensation on relocation.For detailed information on the Award please contact Employee Services Bathurst.1.4.1 ELIGIBILITYTo be eligible for the benefits available under the Award, a staff member must satisfy therequirements <strong>of</strong> location <strong>and</strong> basis <strong>of</strong> transfer as specified in clause 1 <strong>of</strong> the Award. This clauseidentifies a ‘transferred <strong>of</strong>ficer’ as an <strong>of</strong>ficer who is assigned to a new location (other than from onepart <strong>of</strong> the metropolitan area to another) at which duty is to be performed <strong>and</strong> who, as aconsequence <strong>of</strong> such assignment, finds it necessary to leave their existing residence <strong>and</strong> take up anew residence at the new location. For example, a school administrative <strong>and</strong> support staff memberwould be entitled to the benefits <strong>of</strong> the Award when they relocate to accept appointment to aposition obtained by either merit selection or transfer following a reduction in hours or abolition <strong>of</strong>their previous position.This definition <strong>of</strong> a ‘transferred <strong>of</strong>ficer’ does not include a staff member transferred at their ownrequest, under an arrangement between <strong>of</strong>ficers to exchange positions or on account <strong>of</strong> anymisconduct.The benefits <strong>of</strong> the Award do not apply on first <strong>employment</strong> or re-<strong>employment</strong>.There are limited circumstances where the Award provisions may apply to temporary staff members.Benefits are not <strong>general</strong>ly available to staff members who transfer within the metropolitan area orwhen a change in residence is not necessary in order for staff member to take up the newappointment.For the purposes <strong>of</strong> the Award, the ‘metropolitan area’ is defined as the Sydney region <strong>and</strong> includesthe area referred to as the Central Coast on the Northern Line as far as Gosford, the area on theWestern Line as far as Mt Victoria <strong>and</strong> the area on the Southern Line as far as Wollongong.1.4.2 ENTITLEMENTS1.4.2.1 LeaveA staff member who is entitled to receive the benefits <strong>of</strong> the Award is entitled to thefollowing leave entitlements:a) two days special leave on full pay for the purpose <strong>of</strong> obtaining accommodation at thenew location. This leave may be taken before or after the actual date <strong>of</strong> transfer;b) two days special leave on full pay for the purpose <strong>of</strong> preparation <strong>and</strong> packing <strong>of</strong>personal <strong>and</strong> household effects prior to removal;c) one day special leave for the purpose <strong>of</strong> either cleaning the residence being vacatedor settling in <strong>and</strong> occupying the new residence; <strong>and</strong>d) such special leave as is necessary to travel to the new location for the purpose <strong>of</strong>commencing duty, <strong>and</strong>/or for the purposes referred to in a) above.H<strong>and</strong>book for non teaching staff in schools January 2009 Page 1 - 27
