4 LEAVEb) the person concerned being as defined in Section 4.6.1.4.6.5.2 A staff member with responsibilities in relation to a person who needs their care <strong>and</strong>support shall be entitled to use sick leave available from that year's annual sick leaveentitlement minus any sick leave taken from that year's entitlement to provide care<strong>and</strong> support for such persons when they are ill.4.6.5.3 Sick leave accumulates from year to year. In addition to the current year's grant <strong>of</strong>sick leave available under Section 4.6.5.2 above, sick leave accrued from theprevious three years may also be accessed by a staff member with responsibilities inrelation to a person who needs their care <strong>and</strong> support.4.6.5.4 The Director-General may, in special circumstances, make a grant <strong>of</strong> additional sickleave. This grant can only be taken from sick leave accrued prior to the periodreferred to in Section 4.6.5.3 above.4.6.5.5 The staff member shall, if required, establish either by production <strong>of</strong> a medical orstatutory declaration, the illness <strong>of</strong> the person concerned <strong>and</strong> that the illness is suchas to require care by another person.4.6.5.6 The staff member has the right to choose the method by which the grounds for leaveis established, that is, by production <strong>of</strong> either a medical certificate or statutorydeclaration.4.6.5.7 The staff member is not required to state the exact nature <strong>of</strong> the relevant illness oneither a medical certificate or statutory declaration.4.6.5.8 The staff member shall, wherever practicable, give the principal notice prior to theabsence <strong>of</strong> the intention to take leave, the name <strong>of</strong> the person requiring care <strong>and</strong> thatperson's relationship to the staff member, the reasons for taking such leave <strong>and</strong> theestimated length <strong>of</strong> absence. If it is not practicable for the staff member to give priornotice <strong>of</strong> absence, the staff member shall notify the principal by telephone <strong>of</strong> suchabsence at the first opportunity on the day <strong>of</strong> absence.4.6.5.9 In normal circumstances, the staff member must not take leave under this Sectionwhere another person has taken leave to care for the same person.4.6.6 OTHER LEAVEThe Director-General may grant staff members other forms <strong>of</strong> leave such as accrued recreationleave (if applicable) <strong>and</strong> time <strong>of</strong>f in lieu for family <strong>and</strong> community service leave purposes. Staffmembers whose recreation leave is paid during the first four weeks <strong>of</strong> the summer vacation (egschool administrative <strong>and</strong> support staff) should discuss the effect <strong>of</strong> taking recreation leave atanother time with Employee Services Bathurst as this will lead to a no pay vacation adjustment.See Section 1.6.2.9 Time Off in Lieu <strong>of</strong> Payment for Overtime, for more information on time inlieu.H<strong>and</strong>book for non teaching staff in schools 2007 Page 4 - 35
