4 LEAVEa) To take accrued recreation leave as leave. Any period <strong>of</strong> recreation leave takenas leave is regarded as service <strong>and</strong> accrues further recreation leave. The lastday <strong>of</strong> service is the last date <strong>of</strong> any recreation (if applicable) or extended leavegranted as leave <strong>of</strong> absence.b) To be paid the value <strong>of</strong> the accrued leave as a gratuity. The monetary value <strong>of</strong>leave is to be calculated as if the staff member were still in the <strong>Department</strong> <strong>and</strong>was merely going on leave. Payment is for the period which commences on thefirst working day, <strong>and</strong> ceases on the last working day covered by accrued leaveminus any leave taken. The last day <strong>of</strong> service is the last day <strong>of</strong> duty, <strong>and</strong> furtherrecreation leave does not accrue.c) To take part <strong>of</strong> the accrued leave as leave <strong>and</strong> be paid the value <strong>of</strong> theremainder <strong>of</strong> the accrued leave as a gratuity.4.9.4.3 Effect <strong>of</strong> Salary Adjustment – Last Day <strong>of</strong> ServiceWhere the last day <strong>of</strong> service falls on or after the date <strong>of</strong> effect <strong>of</strong> a salaryadjustment, the monetary value <strong>of</strong> leave taken as a gratuity should be based uponthe new salary rate.4.9.4.4 Retirement on Medical GroundsFor the purposes <strong>of</strong> initially determining the last day <strong>of</strong> service it shall be assumedthat the value <strong>of</strong> accrued leave will be taken as a gratuity. The <strong>Department</strong> shalltherefore inform the staff member <strong>of</strong> the last day <strong>of</strong> service, as initially determined.The staff member may then elect to exercise one <strong>of</strong> the options in Section 4.9.4.2above. This election is to be made in writing.4.9.5 PAYMENT OF RECREATION LEAVE AFTER DEATH4.9.5.1 CalculationWhere a staff member dies, the recreation leave is to be calculated up to <strong>and</strong>including the date <strong>of</strong> death.4.9.5.2 Payment <strong>of</strong> EntitlementThe monetary value <strong>of</strong> all recreation leave <strong>and</strong> extended leave accrued, but nottaken or forfeited at the date <strong>of</strong> death (including the balance <strong>of</strong> leave which has beenpartly taken), is to be paid to the staff member's nominated beneficiary. If nobeneficiary has been nominated, the monetary value <strong>of</strong> the leave is to be paid to thefollowing in order:a) the spouse <strong>of</strong> the staff member; or if noneb) the children <strong>of</strong> the staff member (including adult sons <strong>and</strong> daughters, notnecessarily dependent) or, if there is a guardian <strong>of</strong> the children then to theguardian for the children's maintenance, education <strong>and</strong> welfare; or if there isnonec) other dependent relative(s), or if noned) to the staff member's estate.H<strong>and</strong>book for non teaching staff in schools 2007 Page 4 - 46
