4 LEAVE4.6 FAMILY AND COMMUNITY SERVICE LEAVE, SICK LEAVE TO CARE FORA FAMILY MEMBER AND FLEXIBLE USE OF OTHER LEAVEENTITLEMENTS4.6.1 DEFINITIONSThe definition <strong>of</strong> "family" <strong>and</strong> "relative" for these purposes is as follows:a) a spouse <strong>of</strong> the staff member; orb) a de facto spouse being a person <strong>of</strong> the opposite sex to the staff member who lives withthe staff member as her husb<strong>and</strong> or his wife on a bona fide domestic basis although notlegally married to that staff member; orc) a child or an adult child (including an adopted child, a stepchild, a foster child or an exnuptial child), parent (including a foster parent <strong>and</strong> legal guardian), gr<strong>and</strong>parent,gr<strong>and</strong>child or sibling <strong>of</strong> the staff member or spouse or de facto spouse <strong>of</strong> the staffmember; ord) a same sex partner who lives with the staff member as the de facto partner <strong>of</strong> that staffmember on a bona fide domestic basis; ore) a relative <strong>of</strong> the staff member who is a member <strong>of</strong> the same household, where for thepurposes <strong>of</strong> this paragraph:i) "relative" means a person related by blood, marriage, affinity or Aboriginal kinshipstructures;ii) "affinity" means a relationship that one spouse, because <strong>of</strong> marriage, has to bloodrelatives <strong>of</strong> the other; <strong>and</strong>iii) "household" means a family group living in the same domestic dwelling.4.6.2 FAMILY AND COMMUNITY SERVICE LEAVE – GENERAL4.6.2.1 The Director-General shall, in the case <strong>of</strong> emergencies or in personal or domesticcircumstances, grant to a permanent or long term temporary staff member some orall <strong>of</strong> the available family <strong>and</strong> community service leave on full pay.4.6.2.2 Such cases may include but not be limited to the following:a) compassionate grounds – such as the death or illness <strong>of</strong> a close member <strong>of</strong> thefamily or a member <strong>of</strong> the staff member's household;b) emergency accommodation matters up to one day – such as attendance at courtas defendant in an eviction action, arranging accommodation, or when requiredto remove furniture <strong>and</strong> effects;c) emergency or weather <strong>conditions</strong> – such as when flood, fire, snow or disruptionto utility services etc. threaten a staff member’s property <strong>and</strong>/or prevent a staffmember from reporting for duty;d) attending to family responsibilities – such as citizenship ceremonies, parent/staffmember interviews or attending child's school for other reasons;e) attendance at court by a staff member to answer a charge for a criminal <strong>of</strong>fence,H<strong>and</strong>book for non teaching staff in schools 2007 Page 4 - 33
