152 | the essential guide to family and medical leave Chapter Highlights A medical certification is a document verifying an employee’s need to take leave for a serious health condition, completed by a health care provider. To be valid, a certification must state: • the date when the serious health condition began • how long the condition is expected to last • which category of serious health condition applies and medical facts relating to that conclusion, and • that the employee is unable to perform the functions of his or her job (if the employee is taking leave for his or her own condition) or that the employee’s family member needs care (if the employee is taking leave for a family member’s condition). You should request a medical certification whenever an employee takes FMLA leave for a serious health condition. You must request a medical certification, in writing, within two business days after learning that an employee needs leave for a serious health condition. The employee must return the certification before going on foreseeable leave; within 15 days after your request; or as soon afterwards as is reasonably possible. Once you receive a medical certification, you may grant FMLA leave or deny it based on the information on the form. If the form is insufficient, you must tell the employee and give him or her time to correct the problem before denying leave. If you have reason to doubt the certification, you may ask the employee to get a second opinion, at your company’s expense. If the first and second opinions conflict, you may request a third opinion, again at the company’s expense. You may ask an employee to provide a recertification only after the original certification runs out or no more often than every 30 days, unless circumstances have changed significantly, you have reason to suspect the employee’s reason for leave, or the employee requests an extension of leave.
