Temporary disability insurance. A state insurance program that provides partial<br />

wage replacement while an employee is unable <strong>to</strong> work due <strong>to</strong> a temporary<br />

disability, including pregnancy.<br />

Termination. End of employment by any means other than resignation,<br />

retirement, or disability.<br />

Third opinion. A third medical certification, from a health care provider<br />

chosen jointly by the employer and the employee, which breaks the tie<br />

when the first and second medical certifications conflict as <strong>to</strong> whether the<br />

employee has a serious health condition.<br />

Title VII. <strong>The</strong> federal law that prohibits discrimination in employment on the<br />

basis race, color, national origin, sex (including pregnancy), and religion.<br />

Undue hardship. A reasonable accommodation that would cause significant<br />

difficulty or expense, considering the nature and cost of the accommodation,<br />

the size and financial resources of the business and the facility where<br />

the employee works, the structure of the business, and the effect the<br />

accommodation would have on the business.<br />

Unforeseeable need for leave. A reason for FMLA leave that is not known in<br />

Workers’ compensation. An insurance program run by the states, which<br />

provides wage replacement, reimbursement for medical bills, and other<br />

benefits <strong>to</strong> employees who suffer work-related injuries or illnesses.<br />

Worksite. <strong>The</strong> company location where an employee works, which may<br />

include a “c<strong>amp</strong>us” of buildings grouped <strong>to</strong>gether or unconnected buildings<br />

used by a company within a reasonable geographic vicinity (for ex<strong>amp</strong>le,<br />

within the city limits). l
