Abstract<br />

The Framework for the Ibero-American Social Identification, a complement<br />

to the 2007 Ibero American Charter on E-Government, is an initiative that<br />

was presented by Argentina, at the XIII Meeting of the Ibero American<br />

Network of Ministers of the Presidency and Equivalent (RIMPE), in<br />

which subjects related to Citizen Participation in the E-government era:<br />

Education for Citizens and Digital Inclusion, were dealt with.<br />

We consider that the Framework for the Ibero-American Social<br />

Identification is relevant for various reasons:<br />

a. It is the first expression of understanding among the Ibero-American<br />

countries that addresses the identification and the use of technology<br />

issues.<br />

b. It introduces the electronic authentication concept, as a link between<br />

the concepts of individuals identification in physical environments and<br />

the electronic/digital signature.<br />

c. It is the first time that a document deals in a jointly fashion with both<br />

issues, individuals identification in physical environments and individuals<br />

identification in electronic environments.<br />

d. It is the first expression of understanding among the Ibero-American<br />

countries that agree on a common glossary on the issues related to<br />

e-commerce, digital government and authentication in electronic<br />

environments.<br />

e. It constitutes a valuable antecedent to attain future agreements for<br />

mutual acknowledgement of digital signatures.<br />

Therefore, we then understand that the Framework for the Ibero-American<br />

Social Identification turns to be a big leap forward. In this paper we analyze<br />

the mentioned framework from the legal point of view, identifying those<br />

aspects that are relevant from our legal system.<br />

We are pursuing to start an interchange of opinions on these aspects, with<br />

the aim of contributing, in the middle term, to the attainment of agreements<br />

to facilitate individuals access to e-commerce and e-government.<br />
