On the other hand, Law No. 26.061 establishes the right to have identity papers in its article 13. It<br />

expressly recognizes the right to obtain public documents to prove the identity of all children,<br />

adolescents and mothers lacking identity documents, in line with provisions of Law No. 24.540.<br />

ARTICLE 13. — RIGTH TO OBTAIN AN IDENTITY DOCUMENT. Children, adolescents and<br />

mothers lacking identity documents, have the right to obtain public documents to prove their<br />

identity, in line with current regulation in the terms set forth in the procedures foreseen in Law<br />

No. 24.540.<br />

Decree No. 415/06 regulating the above mentioned Law, establishes that the national identity<br />

documents shall be free for every child and adolescent born in the national territory, i.e., until<br />

they are 18 years old.<br />

ARTICLE 13: It is declared that the issuance of the first National Identity Document shall be free<br />

for every child and adolescent born in the national territory.<br />

Newborns identification procedure<br />

The procedures for newborns identification are established by Law No. 24.540, applied to all<br />

babies born in the national territory, alive or dead, and their mother. In the cases when the<br />

delivery is in a medical centre, the article 2 establishes that during labour the mother shall<br />

be identified, and after delivery and before cutting the umbilical cord the newborn has to be<br />

identified, in line with the procedures foreseen in article 6.<br />

The Law provides for anomalous situations such as a premature or malformed baby which<br />

make the capture of foot and finger prints not possible. It establishes that the Citizen National<br />

Register, responsible agency in the issue of individuals’ identification in our country, shall be the<br />

application authority. (CASAL; 2010)<br />

In its article 6, Law No. 26.061 establishes the procedure to follow for the identification of the<br />

newborn and the relationship with his or her mother.<br />

ARTICLE 6 — Identification shall be performed on a unique file, numbered by the Citizen<br />

National Register, in three copies, containing the following data:<br />

— About the Mother: first and last name, national identity document type and number and<br />

10-fingerprint.<br />

— About the Child: name under which the newborn shall be registered, sex, right palm and foot<br />

prints and classification of both.<br />

— If the baby was born alive.<br />

— First and last name and signature of the intervening identifier.<br />

— First and last name and signature of the intervening doctor or professional who assisted in<br />
