RESEARCH GIFTS, GRANTS, AND CONTRACTS<br />

Sec. 14. (a) Research conducted under the auspices <strong>of</strong> the University<br />

may be supported in whole or in part through funds provided by outside<br />

donors in the form <strong>of</strong> research gifts, grants, or contracts. Such arrangements<br />

must be approved, before acceptance, by the President or his delegate. Staff<br />

members may conduct preliminary negotiations with prospective grantors or<br />

contractors with the prior knowledge and approval <strong>of</strong> the department head<br />

or other appropriate administrative <strong>of</strong>ficer and the dean or director, if required<br />

by college policy, but have no authority to bind the University to enter<br />

into a contract. Such research programs shall be controlled and directed by<br />

the University and shall be conducted within the appropriate department by<br />

members <strong>of</strong> the University staff. The administrative coordination <strong>of</strong> such<br />

programs shall be under the Agricultural Experiment Station for departments<br />

in the College <strong>of</strong> Agriculture, the Engineering Experiment Station for departments<br />

in the College <strong>of</strong> Engineering, and the University Research Board<br />

for all other departments.<br />

(b) Contracts for research shall specify that the results <strong>of</strong> scientific<br />

research conducted by the University, including patentable discoveries, are<br />

the property <strong>of</strong> the University, to be used for the benefit <strong>of</strong> the University<br />

and the public, but if such patentable discoveries have commercial value, the<br />

sponsoring agency may receive preferential consideration in the administration<br />

<strong>of</strong> the patent.<br />

(c) The University shall not enter into an agreement with a sponsoring<br />

agency which will give it permanently the exclusive benefits <strong>of</strong> the results <strong>of</strong><br />

such investigation or research, except under certain contracts with agencies<br />

<strong>of</strong> the United States Government, when such exceptions are in the national<br />

interest. The original records <strong>of</strong> any investigation shall be held by the University,<br />

but reports or copies <strong>of</strong> such records may be furnished to the sponsoring<br />

agency. The University shall have the exclusive right to publish, at its<br />

discretion, the results <strong>of</strong> scientific investigation and research, unless provided<br />

otherwise in contracts with agencies <strong>of</strong> the United States Government or<br />

state <strong>of</strong> Illinois. No account <strong>of</strong> a cooperative research project or reprints <strong>of</strong><br />

scientific articles resulting from the investigation shall be published by the<br />

sponsor or by any other agency, except with the consent <strong>of</strong> the University.<br />

The sponsoring agency shall not use the name <strong>of</strong> the University in any advertisement,<br />

whether with reference to a cooperative investigation or otherwise,<br />

without the prior approval <strong>of</strong> the President <strong>of</strong> the University.<br />

(d) If conditions imposed by the sponsoring agency require the waiver<br />

<strong>of</strong> established University policies, such as those concerned with full reimbursement<br />

for indirect costs, rights <strong>of</strong> publication, or ownership <strong>of</strong> potentially<br />

patentable inventions or developments, such conditions may be accepted by<br />

the University, if required by federal law or the established policies <strong>of</strong> the<br />

sponsor, when the sponsoring agency is governmental or non-pr<strong>of</strong>it in character<br />

; and if the action <strong>of</strong> the University in waiving such policies is determined<br />

to be clearly in the public interest by the committee specified in<br />

paragraph (f) following. Other than the exceptions indicated above, all<br />

gifts, grants, and contracts shall be accepted under conditions imposed by<br />

relevant University statutes and rules.<br />

(e) The University shall generally accept funds for research from spon-
