execute, acknowledge, and deliver in the name and on behalf <strong>of</strong> this Corporation,<br />

such instrument <strong>of</strong> conveyance, contract, or other document or documents, as to<br />

them may seem necessary or desirable in order to effectuate a conveyance to<br />

Central Illinois Public Service Company, hereinafter referred to as "Grantee,"<br />

its successors or assigns, <strong>of</strong> a right <strong>of</strong> way easement over and upon, and with<br />

the right to construct, operate, patrol and maintain a transmission line, including<br />

poles, anchors and necessary fixtures and wires attached thereto, over and upon<br />

the land hereinafter described, for the transmission <strong>of</strong> electrical energy and<br />

communication, such line to form a part <strong>of</strong> an electrical transmission and telephone<br />

system to be owned and operated by the said Grantee, its successors or<br />

assigns, and also the right to remove or trim all brush and trees on the said<br />

land within Fifty Feet (50') <strong>of</strong> the said transmission line, together with the<br />

right <strong>of</strong> access to the said land. Any damage to any property <strong>of</strong> this corporation,<br />

its assigns, or tenants, caused by the employees <strong>of</strong> the Grantee, its successors<br />

or assigns, shall be promptly paid by the said Grantee, its successors or assigns.<br />

The right-<strong>of</strong>-way easement shall terminate ninety (90) days after the Grantee<br />

ceases to use said transmission line for rendition <strong>of</strong> service. The right-<strong>of</strong>-way<br />

easement shall be over the following described property:<br />

Tract Number One<br />

The East (E) Two Hundred Feet <strong>of</strong> the North One Half (N y2) <strong>of</strong> the<br />

North East Quarter (NE J4) <strong>of</strong> the Northwest Quarter (NW %) <strong>of</strong> Section<br />

Eleven (Sec. II) in Township Eighteen North (T 18 N) Range Eight East<br />

(R 8 E) <strong>of</strong> the Third Principal Meridian (3rd P.M.) in the County <strong>of</strong> Champaign,<br />

and State <strong>of</strong> Illinois.<br />

Tract Number Two<br />

The East (E) Two Hundred Feet (200') <strong>of</strong> the South (S) Three Hundred<br />

Feet (300') <strong>of</strong> the South West Quarter (SW VA) <strong>of</strong> Section Two (Sec. 2) in<br />

Township Eighteen North (T 18 N), Range Eight East (R 8 E) <strong>of</strong> the Third<br />

Principal Meridian (3rd P.M.) in the County <strong>of</strong> Champaign and State <strong>of</strong> Illinois.<br />

The said transmission line shall be located Five Feet (5') West <strong>of</strong> the East<br />

line <strong>of</strong> the above described Tract Number One (i) from the South Line <strong>of</strong><br />

the public highway which extends East and West along the North line <strong>of</strong> the<br />

said Tract Number (1) to a point which is Five Hundred Twenty Five Feet<br />

(525') South there<strong>of</strong>.<br />

Also, One (1) pole to be placed One Foot (1') North <strong>of</strong> the North Line<br />

<strong>of</strong> the above described highway and One Foot (1') West <strong>of</strong> the East Line <strong>of</strong><br />

the above described Tract Number Two (2). One (1) anchor to be placed<br />

Twenty Five Feet (25') North <strong>of</strong> the above described pole.<br />

On motion <strong>of</strong> Mr. Swain, the foregoing resolution was adopted by<br />

the following vote: Aye, Mr. Herrick, Mr. Hughes, Mr. Johnston.<br />

Mr. Livingston, Mr. Swain, Mrs. Watkins, Mr. Williamson; no, none;<br />

absent, Mr. Bissell, Mrs. Holt, Mr. Nickell, Mr. Stratton.<br />

EASEMENT FOR EXTENSION OF FLORIDA AVENUE<br />

(14) The Board <strong>of</strong> Trustees has approved in principle the University's participation<br />

in the extension and improvement <strong>of</strong> Florida and Kirby Avenues which<br />

includes construction <strong>of</strong> a subway under the Illinois Central Railroad right-<strong>of</strong>way.<br />

Agreement has now been reached with city, county, and state <strong>of</strong>ficials<br />

regarding the University's participation. Its sole contribution will be the granting<br />

<strong>of</strong> a right-<strong>of</strong>-way easement over a strip <strong>of</strong> land south <strong>of</strong> the present Florida<br />

Avenue right-<strong>of</strong>-way between First Street and Lincoln Avenue and over a<br />

strip <strong>of</strong> land extending from Florida Avenue between First Street and the east<br />

line <strong>of</strong> the Illinois Central Railroad right-<strong>of</strong>-way.<br />

No payment will be made to the University for this easement, and the<br />

University will not be responsible for any capital or construction costs, nor tor<br />

any maintenance, cleaning, or repairs <strong>of</strong> the roadway or the pumping and<br />

drainage system. The University will retain the right to extend sidewalks,<br />

streets, and drives across the easement in the future, the cost <strong>of</strong> such extensions<br />

to be at the expense <strong>of</strong> the University.<br />

Since state motor fuel tax funds and federal funds will be used in part
