$6,875. Those services included, among others, a careful examination <strong>of</strong> the entire<br />

record in the case, the briefs filed in the trial court, the appeal papers, and the<br />

abstract <strong>of</strong> record and briefs filed in the Supreme Court by the plaintiffs; conferences<br />

with the University Legal Counsel and with Pr<strong>of</strong>essors Russell N. Sullivan<br />

and Rubin G. Cohn who had assisted the Legal Counsel in the trial court; the<br />

preparation and filing <strong>of</strong> additional appeal papers, <strong>of</strong> an additional abstract <strong>of</strong><br />

record, and <strong>of</strong> the University's brief in the Supreme Court; and the oral argument<br />

<strong>of</strong> the case in the Supreme Court.<br />

The case presented several issues <strong>of</strong> great importance to the University; the<br />

decision <strong>of</strong> the Supreme Court in it is very gratifying and will prove very helpful<br />

and beneficial to the University in numerous respects; and the charge made by<br />

Mr. Jenner's firm for his and Mr. Marshall's services in the case is proper and<br />

reasonable having due regard to the importance <strong>of</strong> the case, the results obtained,<br />

and the time and work they were required to devote to it. It, in fact, constitutes<br />

appreciably less than is usually charged by their firm for services which consume<br />

as much time and are <strong>of</strong> comparable difficulty and importance.<br />

Accordingly, the Legal Counsel and the Vice-President and Comptroller recommend<br />

that an appropriation <strong>of</strong> $6,875 be made to the Legal Counsel's <strong>of</strong>fice<br />

from the General Reserve Fund and that they be authorized to pay for the services<br />

<strong>of</strong> Mr. Jenner and Mr. Marshall in this case with and from the same.<br />

I concur.<br />

On motion <strong>of</strong> Mrs. Holt, payment for these services was authorized,<br />

as recommended, and the appropriation requested was made by<br />

the following vote: Aye, Mr. Bissell, Mrs. Holt, Mr. Hughes, Mr.<br />

Johnston, Mr. Livingston, Mr. Nickell, Mrs. Watkins, Mr. Williamson;<br />

no, none; absent, Mr, Herrick, Mr. Stratton, Mr. Swain.<br />
