4. The maximum amounts <strong>of</strong> building space which the Sponsor shall be obligated<br />

to furnish civil agencies <strong>of</strong> the United States for the purposes and on<br />

the terms and conditions stated in Paragraphs 9 <strong>of</strong> Part III <strong>of</strong> the <strong>Project</strong><br />

Application is set forth in the attached schedule <strong>of</strong> Maximum Rent Free Space<br />

Requirements, which is incorporated herein and made a part here<strong>of</strong>.<br />

5. Any misrepresentations or omission <strong>of</strong> a material fact by the Co-Sponsors<br />

concerning the <strong>Project</strong> or the Co-Sponsors' authority or ability to carry out<br />

the obligations assumed by the Co-Sponsors in accepting this Offer shall terminate<br />

the obligation <strong>of</strong> the United States, and it is understood and agreed by the<br />

Co-Sponsors in accepting this Offer that if a material fact has been misrepresented<br />

or omitted by the Co-Sponsors, the Administrator on behalf <strong>of</strong> the<br />

United States may recover all grant payments made.<br />

6. The Administrator reserves the right to amend or withdraw this Offer at any<br />

time prior to its acceptance by the Co-Sponsors.<br />

7. This Offer shall expire and the United States shall not be obligated to pay any<br />

<strong>of</strong> the allowable costs <strong>of</strong> the <strong>Project</strong> unless this Offer has been accepted by<br />

the Co-Sponsors within 60 days from the above date <strong>of</strong> Offer or such longer<br />

time as may be prescribed by the Administrator in writing.<br />

8. The Administrator in tendering this Offer in behalf <strong>of</strong> the United States recognizes<br />

the relationship between the Board <strong>of</strong> Trustees <strong>of</strong> the University <strong>of</strong><br />

Illinois <strong>of</strong> Champaign-Urbana, Illinois and the Department <strong>of</strong> Aeronautics,<br />

State <strong>of</strong> Illinois, created by the Agency and Participation Agreement between<br />

said Universit3> and Department, executed respectively February 19, 1958 and<br />

February 21, 1958, as amended by amendment dated June 17, 1958, raising the<br />

amount <strong>of</strong> the Department's contribution to $240,000.00, copies <strong>of</strong> which<br />

Agreement are attached hereto and made.a part <strong>of</strong> this Grant Agreement. It is<br />

further understood and agreed by the parties hereto that said Agreement will<br />

not be amended, modified or terminated without the approval, in writing, <strong>of</strong> the<br />

Administrator or his duly designated representative.<br />

9. It is understood and agreed between the parties hereto that any reference<br />

herein, or in the aforesaid <strong>Project</strong> Application, to plans and specifications shall<br />

mean the plans and specifications as approved by the Chief, Engineering<br />

Branch, Airports Division, Region 3, Civil Aeronautics Administration, on<br />

March 26, 1958.<br />

10. The Sponsor hereby covenants that it is iis intention and it will make every<br />

reasonable effort consistent with statutory and constitutional limitations imposed<br />

upon it and subject to its ability to secure funds therefor to acquire on<br />

or before March 29, ig6i the title or an easement satisfactory to the Administrator<br />

in land lying within zones, trapezoid in shape, extending outwardly 2000<br />

feet from a point located 200 feet outward from each end <strong>of</strong> the N/S runway<br />

measured along the centerline there<strong>of</strong> as projected outward, the said zones<br />

being 400 feet wide at the said beginning point, measured equidistant on each<br />

side <strong>of</strong> the projected centerline, and increasing to a width <strong>of</strong> 800 feet at its<br />

outer extremity, measured equidistant on each side <strong>of</strong> the projected centerline.<br />

11. The Sponsor hereby covenants and agrees that, to the extent that the Sponsor<br />

holds or may hereafter acquire ownership or such other rights as may legally<br />

allow it to carry out its obligations under this covenant, it will not permit or<br />

suffer any growth, structure, or object, except farm crops or such structures<br />

as are necessary as aids to air navigation, on any land lying within zones,<br />

trapezoid in shape, extending outwardly 2000 feet from a point located 200 feet<br />

outward from each end <strong>of</strong> the N/S runway along the centerline there<strong>of</strong> as<br />

projected outward, the said zones being 400 feet wide at the said beginning<br />

point, measured equidistant on each side <strong>of</strong> the projected centerline, and increasing<br />

to a width <strong>of</strong> 800 feet at its outer extremity, measured equidistant on<br />

each side <strong>of</strong> the projected centerline.<br />

£he Co-Sponsors' acceptance <strong>of</strong> this Offer and ratification and adoption <strong>of</strong> the<br />

<strong>Project</strong> application incorporated herein by the Board <strong>of</strong> Trustees <strong>of</strong> the University<br />

<strong>of</strong> Illinois shall be evidenced by execution <strong>of</strong> this instrument by the Co-<br />

Sponsors, as hereinafter provided, and said Offer and acceptance shall comprise a<br />

want Agreement, as provided by the Federal Airport Act, constituting the obligations<br />

and rights <strong>of</strong> the United States and the Co-Sponsors, respectively, with<br />

j^spect to the accomplishment <strong>of</strong> the <strong>Project</strong> and the operation and maintenance <strong>of</strong><br />

we Airport. Such Grant Agreement shall become effective upon the Co-Sponsors'
